Abstract

V diplomskem delu sta proučena temeljna zakona, po katerih se mora ravnati slovenska policija. Na začetku dela je kratek opis policije in njene organiziranosti, sledi predstavitev razvoja policije skozi čas, nadaljuje se z zgodovinskim razvojem policije v Republiki Sloveniji, ki zajema različna obdobja. V posameznih časovnih obdobjih so predstavljeni pomembni zgodovinski mejniki oziroma dogodki in njihov vpliv na razvoj organizacije policije. Glavni del diplomskega dela obsega obravnavo Zakona o organiziranosti in delu v policiji in Zakona o nalogah in pooblastilih policije oziroma njune spremembe, ki jih je Vlada Republike Slovenije predstavila v predlogu obeh zakonov. Predstavljene so ključne novosti, spremembe in ukinitve posameznih določb v do zdaj veljavnih zakonih. Zakona sta predstavljena vsak v svojem poglavju, ki se deli na posamezna podpoglavja, v katerih so predstavljeni razlogi za sprejem predloga zakona, njegovi cilji, poglavitne rešitve, ki jih prinašajo spremembe in dopolnitve zakona, finančne posledice predloga zakona ter opis ureditve obravnavanega področja v nekaterih drugih evropskih državah. Diplomsko delo se osredotoča predvsem na temeljne spremembe zakona in rešitve, ki jih spremembe prinašajo. Za splošno javnost najbolj odmevne in pomembne spremembe v predlogu zakona so predpisane prav za policijska pooblastila in prisilna sredstva policije, predvsem uzakonitev električnega paralizatorja, nekaterih novih evidenc, sistema za avtomatizirano preverjanje registrskih tablic itd.

Secondary abstract: The thesis examines the basic laws that must be followed by the Slovenian police. At the beginning of the work is a brief description of the police and its organization, followed by a presentation of the development of the police through time, continues with the historical development of the police in the Republic of Slovenia, covering various periods. Important historical milestones or events and their influence on the development of the organization of the police are presented in individual time periods. The main part of the thesis includes the consideration of the Law on Organization and Work in the Police and the Law on Police Tasks and Authorizations and their amendments, which the Government of the Republic of Slovenia presented in the proposal of both laws. Key novelties, changes and deletions of individual provisions are presented in the laws in force up to now. The Law is presented each in its chapter, which is divided into individual subsections, presenting the reasons for the adoption of the bill, its objectives, the main solutions brought by changes and amendments to the law, the financial implications of the draft law, and a description of the regulation of the subject area in some Other European countries. The thesis focuses primarily on the fundamental changes in the law and the solutions brought about by the changes. For the general public most prominent and significant changes in the draft law are prescribed precisely for police powers and forcible means of police, in particular the legalization of an electric paralizer, some new records, an automated system for checking registration plates, etc.
