Abstract

Zaposleni in študenti na univerzah se srečujejo s številnimi težavami, povezanimi z avtorskimi deli, ki nastanejo tekom pedagoškega, raziskovalnega in izobraževalnega procesa. Zbornik združuje različne prispevke, ki so povezani s to tematiko: od poskusa opredelitve avtorskih del zaposlenih, ki nastanejo v delovnem razmerju; analize dopustnega reproduciranja v okviru vsebinskih omejitev avtorskih pravic; digitalizacije avtorskih del in njihovega posredovanja za namene izobraževanja; opredelitve akademskega plagiata; analize predloga direktive o avtorski pravici na digitalnem trgu, ki ima vpliv tudi na razmerja na univerzi; do analize kakovosti znanstvenih revij, v katerih zaposleni na univerzi objavljajo svoja znanstvena dela, in s tem povezanim odprtim dostopom do vsebine teh revij; ter možnosti napovedovanja uspešnosti študentov s poudarkom na avtorskopravnem varstvu zbirke podatkov ter varstvu osebnih podatkov študentov. Temeljna ugotovitev je, da težavam, s katerimi se univerza, njeni zaposleni in študenti soočajo v povezavi z različnimi avtorskopravnimi vprašanji, botrujejo nejasna pravna pravila in njihova nezadostna prilagojenost sodobni tehnologiji. Posledično bi bilo treba postaviti jasnejša pravila glede opredelitve avtorskih del, ki sodijo med dela, ki jih zaposleni na univerzi, ustvarijo v delovnem razmerju, po drugi strani pa vsebinske omejitve avtorskih pravic spremeniti tako, da bodo za namene izobraževanja prilagojene sodobnejšim tehnikam poučevanja.

Secondary abstract: Employees and students at the universities are facing numerous problems coupled with copyrighted works created in the course of pedagogical, research and educational process. The collected paper consists of several papers related to this topic: the attempt to define copyrighted works of employees created within the scope of employment; analysis of lawful reproduction of copyrighted works in the context of copyright restrictions; digitalisation of copyrighted works and their dissemination for the educational purposes; definition of academic plagiarism; analysis of proposal for a directive on copyright in the digital market and its impact on universities relations; analysis of a quality of scientific journals in which scientific works of employees at the universities are published and open access of such works; and the possibility to predict students’ success with special emphasis of copyright protection of databases and the protection of students’ personal data. The main reasons for problems arising at universities relating to copyright are ambiguous legal rules and their insufficient adjustment to modern technology. Thus, clearer rules should be adopted considering the definition of copyrighted works created in the course of employment and copyright restrictions for educational purposes should be adjusted to modern teaching approaches.
