Abstract

V svojem magistrskem diplomskem delu z naslovom Obravnavanje mladoletnih storilcev nasilnih kaznivih dejanj sem raziskovala področje mladoletniške nasilne kriminalitete. V prvem delu sem pojasnila nekaj osnovnih pojmov ter zgodovino mladoletniškega sodstva, ki je pomembna zato, da razumemo današnji sistem obravnavanja mladoletnikov. Predstavila sem tudi zaščitniški in pravičnostni model obravnavanja mladoletnikov in model obravnavanja, kot ga imamo v Sloveniji. V osrednjem delu sem se skušala osredotočiti predvsem na obravnavanje mladoletnikov, ki so storili nasilno kaznivo dejanje, ter izpostaviti značilnosti njihovega obravnavanja. Izpostavila sem nekaj tujih in domačih pravnih virov, ter tujo pravno prakso v zvezi z obravnavanjem mladoletnih storilcev nasilnih kaznivih dejanj. Ob tem sem skušala izpostaviti tudi nekatere dobre in slabe prakse. Pojasnila sem kateri dejavniki vplivajo na to, da mladoletniki storijo nasilna kazniva dejanja. Glede samega obravnavanja mladoletnikov v Sloveniji sem se pri sankcijah osredotočila na zavodski vzgojni ukrep oddaja v prevzgojni dom in na kazen mladoletniškega zapora, saj sklepam, da so nasilna kazniva dejanja, ki veljajo za najhujša kazniva dejanja, najpogosteje sankcionirana z opisanima sankcijama. S pomočjo statističnih podatkov sem prikazala deleže mladoletnikov v prevzgojnem domu in v mladoletniškem zaporu, pred tem pa še delež mladoletniške nasilne kriminalitete. Na koncu sem predstavila svoje ugotovitve in potrdila oziroma ovrgla postavljene hipoteze.

Secondary title: Discussion of the juvenile offenders of the violent criminal offences
Secondary abstract: In my master’s thesis, titled Discussion of the juvenile offenders of the violent criminal offences, I researched the field of violent juvenile crime. In the first part, I explained some basic conceptions and the history of the juvenile judiciary, which is important in order to understand the today’s system of treating juveniles. I also presented the protective model and the equity model of treating juveniles and the model of treatment, as we have it in Slovenia. In the central part, I tried mostly to focus on treating juveniles who committed a violent criminal offence and to point out the characteristics of their treatment. I pointed out some foreign and domestic sources of law and some foreign legal practices in connection with treating the juvenile offenders of violent criminal offences. In the process, I tried to point out also some good and poor practices. I explained which factors influence the minors to commit violent criminal offences. With regards to the treatment of minors in Slovenia, and with regards to sanctions, I focused on institutional corrective measure of placement to correctional facility and on the penalty of juvenile detention, for I conclude that violent criminal offences, which are believed to be the worst criminal offences, are most often sanctioned by the described sanctions. By means of statistical data, I showed the shares of juveniles in the correctional facility and in juvenile detention. Before that, I showed the share of violent juvenile crime. At the end, I presented my ascertainments and confirmed or rejected the set hypotheses.
