Abstract

Mednarodna vesoljska postaja je vesoljska postaja s posadko v nizki zemeljski orbiti in je v vlogi laboratorija za raziskovanje mikrogravitacije in vesoljskega okolja. Vesoljska postaja je plod mednarodnega sodelovanja med ZDA, Rusijo, Kanado, Japonsko in članicami Evropske vesoljske agencije. Pravno podlago projekta predstavlja Medvladni sporazum o sodelovanju na civilni vesoljski postaji (sprejet 1998), ki ga dopolnjujejo štirje memorandumi o razumevanju, sklenjeni med NASA in vesoljskimi agencijami ostalih držav. Ti pravni viri določajo natančne zaveze posameznih partnerjev, lastništvo elementov vesoljske postaje, vzpostavljajo mehanizme za usklajevanje dela pri razvoju in uporabi vesoljske postaje, alokacijo časa za posadko in rabo elementov vesoljske postaje, evolucijo postaje in še bi lahko naštevali. Pravni viri rešujejo tudi vprašanja pristojnosti nad osebami na vesoljski postaji, intelektualne lastnine, nastale iz dela na vesoljski postaji, odškodninske odgovornosti za škodo, nastalo v zvezi z vesoljsko postajo, tajnosti podatkov in blaga, ki se mora med partnerji izmenjati za uspešno izvedbo programa, financiranja programa in mehanizmov za razreševanje morebitnih težav, nastalih v življenju programa.

Secondary abstract: The International space station is a space station in low earth orbit that serves as a laboratory for microgravity and space environment research. It is the fruit of international cooperation between the USA, Russia, Canada, Japan, and the members of the European space agency. The legal framework for the program is provided by The International Space Station Intergovernmental Agreement (signed in 1998), accompanied by four memoranda of understanding between NASA and the space agencies of the other partners. This framework establishes the commitments of the partners, the ownership of the space station elements, establishes mechanisms for coordination of development and utilization of the station, allocation of crew time and utilization of elements, space station evolution programs, and others. The framework also establishes rules regarding the jurisdiction over the persons on the space station, intellectual property resulting from research on the space station, liability for damage arising from the space station operation, confidentiality of data and goods exchanged between partners, program financing, and establishes mechanisms for resolution of issues that may arise during the life of the program.
