Abstract

Zdravje je ena tistih dobrin, ki jih imamo za samoumevne, dokler jih ne izgubimo. Ko smo bolni ali poškodovani, je naše največje upanje, da si čimprej povrnemo izginulo telesno in duševno blagostanje. Takrat si želimo delujoč zdravstveni sistem, ki nam bo zagotovil čimprejšnjo zdravstveno obravnavo, s katero se bosta ugotovila razlog za okrnjeno zdravstveno stanje in zdravilo zanj. Vse prepogosto pa se dogaja, da od trenutka napotitve do prve specialistične zdravstvene obravnave preteče kar nekaj časa. Prav tu nastopi problem, saj je ravno čas tista dobrina, ki je pacient navadno nima. Že tako okrnjeno zdravstveno stanje se s potekom časa slabša, poslabšanje pa negativno vpliva na življenjski standard pacienta in njegove družine. Zastavlja se vprašanje, ali lahko kdo odgovarja za (pre)dolgo čakanje pacientov na zdravstvene storitve? Delo bom pričela s predstavitvijo novelirane ureditve področja pravice do spoštovanja pacientovega časa, ki je zaživela ravno v času pisanja te naloge. Kritično bom ovrednotila njene ključne novosti in spremembe ter preučila, kakšne so možnosti za uspešno reševanje problematike čakalnih dob. Dotaknila se bom tudi alternativnih scenarijev, ki se jih lahko poslužijo pacienti, ki v kolesju slovenskega zdravstvenega sistema ne morejo pravočasno prejeti potrebne zdravstvene storitve. Zadnji del naloge pa bom posvetila obravnavi pravnih razmerij med glavnimi akterji na zdravstvenem področju. V sklopu medsebojnih pravic in dolžnosti bom ugotavljala, ali bi lahko kateri izmed njih odškodninsko odgovarjal ter ali jih za kršitev pravice lahko doletijo tudi kakšne druge negativne posledice

Secondary abstract: Health is one of those goods that we take for granted until we lose them. When we are ill or get injured, our biggest hopes reside in regaining physical and mental well-being as soon as possible. At that stage we need a well-functioning healthcare system that will provide us with prompt medical treatment which further on determines the cause of the clinical state along with the cure. However, it is not to be neglected that all too often a lot of time passes from the moment of referral to the first specialist medical treatment. This is exactly the stage where the problem arises since the patient lacks the much needed time. The already affected health condition is worsened with the passage of time which consequently leads to a negative impact on the standard of living of both the patient and his or her family. The question that thus arises is if there is anyone that could be held responsible for the protracted waiting time? I will start my master thesis with the presentation of the novelized regulation in the area that deals with the right to respect the patient's time which came to life right at the time of doing a research. I am going to critically evaluate its key novelties and changes, and thus examine their options for successfully solving the established problem of waiting time. I will also focus on the alternative scenarios that can be used by those patients who cannot obtain the necessary health services within reasonable time in the wheel of the Slovenian healthcare. The last part of the master thesis is dedicated to addressing the legal relationships among the main players in the field of health care system. Within the framework of mutual rights and obligations, I will try to determine the level of possibility for those who are to be held responsible along with assessing the possibility of them being held responsible for any other sanctions as well.
