Abstract
Magistrska naloga obravnava oskrbo s pitno vodo, ki je v Republiki Sloveniji obvezna občinska gospodarska javna služba. Poseben pomen te javne službe je opredeljen z zagotavljanjem najpomembnejšega naravnega vira, kajti voda je vir življenja in potrebna vsem živim bitjem. V formalnem smislu je voda določena kot pitna z namenom uporabe: kot voda, namenjena za pitje, kuhanje, pripravo hrane ali druge gospodinjske namene ter vsa voda, ki se uporablja v proizvodnji in prometu živil in ustreza minimalnim predpisanim zahtevam. Občine so dolžne zagotoviti izvajanje oskrbe s pitno vodo skladno s predpisi, ki urejajo gospodarske javne službe. V Evropski uniji je odločitev, kako organizirati oskrbo s pitno vodo, v pristojnosti držav članic, evropska zakonodaja tako podaja smernice za ustrezno preskrbo s pitno vodo. Na državni ravni oskrbo s pitno vodo opredeljujejo številni zakoni ter podzakonski predpisi, ki skoraj v celoti urejajo sistem oskrbe s pitno vodo, kar pomeni, da je urejanje pomembnih vprašanj s področja oskrbe s pitno vodo prepuščeno občinam. Država nima ustreznih mehanizmov za izvajanje nadzora nad izvajanjem tovrstne oskrbe v občinah. Objekti in naprave, potrebni za izvajanje te javne službe, so infrastruktura lokalnega pomena. Za zagotavljanje primerne oskrbe s pitno vodo je potrebna ustrezna komunalna infrastruktura, ki omogoča izvajanje kakovostnih storitev. Le-ta zahteva velike finančne vložke tako za izgradnjo kot za vzdrževanje. Trenutna infrastruktura je po večini dotrajana in potrebna obnove, ob vsem tem pa pereč problem predstavlja nenamenska poraba sredstev, namenjenih vzdrževanju, katere pa občine uporabljajo v druge namene. Slovenija je država z velikim številom razmeroma majhnih občin, kjer je zagotavljanje oskrbe s pitno vodo problematično z vidika velikega števila izvajalcev, neenakih standardov izvajanja, dragih storitev, pomanjkljivo usposobljenostjo kadrov in oteženim nadzorom nad izvajanjem, zato naloga opozarja na potrebo po večjem sodelovanju in povezovanju občin na področju oskrbe s pitno vodo, predvsem zaradi zagotavljanja večje učinkovitosti izvajanja javne službe. Naloga opozarja tudi na potrebo po sistemski ureditvi oskrbe z vodo v Sloveniji in boljši regulaciji izvajanja javne službe, zato so za ugotovljene pomanjkljivosti v zaključnem delu podani morebitni predlogi za izboljšanje trenutnega stanja na tem področju. Pričujoča naloga vsebuje tudi opredelitev ustavne pravice do pitne vode v povezavi z izvajanjem javne službe, kajti sam vpis še ne zagotavlja učinkovite ureditve oskrbe s pitno vodo, ampak bo potrebna sprememba zakonskih predpisov ob upoštevanju določenih omejitev pri izvrševanju pravice do pitne vode v povezavi z izvajanjem javne službe.

Secondary abstract: |
The master thesis deals with the supply of drinking water, which is obligatory in the Republic of Slovenia by the municipial public service. The particular importance of this public services is defined by the provision of the most important natural resource: because water is the source of life and is needed by all living beings. In the formal sense, water is designated as drinking for the purpose of use: as water intended for drinking, cooking, food preparation or other household purposes and any water used in the production of food and suits minimum prescribed requirements. Municipalities are obliged to ensure the implementation of drinking water supply in accordance with the regulations governing public services. In the European Union, the decision on how to organize drinking water supplies lies within the competence of the Member States, European legislation thus provides guidance on the proper supply of drinking water. At the national level, the supply of drinking water is defined by a number of laws and by-laws that almost entirely regulate the drinking water supply system, which means that the management of important issues in the area of drinking water supply is left to the municipalities. The state does not have adequate mechanisms for control over the implementation of drinking water supply in municipalities. The facilities necessary for the implementation of this public service are infrastructures of local importance. In order to ensure adequate drinking water supply, an adequate communal infrastructure is needed to provide quality services. Infrastructure requires large financial inputs both for construction and for self maintenance, the current infrastructure is worn-out and necessary for reconstruction, but the burning problem is the unintentional use of maintenance funds used by municipalities for other purposes. Slovenia is a country with a large number of relatively small municipalities where the provision of drinking water supply is problematic in terms of a large number of operators, unequal standards of implementation, expensive services, lack of staff training and difficulty in controlling implementation. Therefore, the task draws attention to the need for greater cooperation and integration municipalities in the area of drinking water supply, particular to ensure greater efficiency in the delivery of public services. The thesis also draws attention to the need for systemic regulation of water supply in Slovenia and better regulation of public service delivery. Therefore for deficiencies are given suggestions for improving the current situation in the field of drinking water supply in the final chapter. This thesis also contains the definition of the constitutional right to drinking water in connection with the implementation of the public service, since the entry itself does not provide for an effective regulation of the supply of drinking water, but a change in the legal regulations will be required, subject to certain restrictions in the performance of the public service in connection with the right to drinking water. |
