Abstract

Gospodarstvo je sestavni del vsake države, tako v zasebnem sektorju, kakor tudi sektorju, ki je pod nadzorom državnih organov. V današnjem času se standard življenja v različnih državah meri s pomočjo izračuna bruto domačega proizvoda na prebivalca (BDP), torej večji kot je BDP, višji je standard življenja. Skozi zgodovino se je večal vpliv države na posameznih področji, tako da danes država nadzoruje vse pomembne ustanove, podjetja in zato zaposluje veliko število ljudi. Ker pa država rabi tudi pomoč zasebnega sektorja, podeljuje koncesije ali sklene pogodbo na podlagi javnega naročila s kakšnim zasebnim podjetjem. Zaradi velike konkurence v zasebnem sektorju in zagotavljanju enakovrednosti pri oddaji javnega naročila, je bilo treba omenjeno področje tudi zakonsko urediti. Precej časa je minilo od sprejetja prvega zakona do sprejetja dveh novel – od leta 2016 torej področje javnega naročanja ureja ZJN-3, ki je pravzaprav četrto nadaljevanje Zakona o javnem naročanju. Sprejetje omenjene novele je bilo nujno, saj se mora s tehnološkim razvojem razvijati tudi sistem in postopek javnega naročanja. Omenjena novela bo namreč prva omogočala oddajo ponudb in vse potrebne dokumentacije elektronsko, kar bo pospešilo in olajšalo delo zaposlenim, tako v zasebnem, kakor tudi v javnem sektorju. Z novo novelo je tudi lažji pregled nad področji, ki jih ureja zakon – mnoga področja, ki so bila prej razdrobljena, so sedaj združena vse v en zakon. Novela ima tudi nekaj sprememb, ki sistemsko omogočajo učinkovitejšo izvedbo procesa javnega naročanja, omogočajo pa tudi ekonomično ustreznejšo operativno izvedbo naročila.

Secondary title: Comparison of the second and trird amendment of the public procurement act
Secondary abstract: The economy is an integral part of each country, be it in the private sector, as well as part of the public administration. Today the living standard in different countries is measured by the calculation of the gross domestic product (GDP); meaning the higher the GDP, the higher is the living standard. Through the history the influence of the state in different areas has increased and today the state in control of all important institutions, companies and accordingly employs a large number of employees. Since the state also needs the help of the private sector, it contracts private companies, based on public procurement. Based on the high competition in the private sector and the need to provide equal opportunities for all competitors competing for a public procurement, the procurement process needed to be defined as a law. A lot of time has already passed since the first law was passed and in the meantime was amended twice and since 2016 the public procurement is regulated by ZJN-3 (Public Procurement Act) that is actually the 4th version of the Public Procurement Act. The last amendment was of high priority, since the procedure of public procurement needed to be adopted to the technological developments. The last amendment enables to tender and to submit all required documentation electronically, which will enable the work of employees in the private and in the public sector. The last amendment also enables an overview over all areas of action that are covered by the Public Procurement Act – many different areas of action were fragmented and now they are all covered by one law. The amendment also includes some changes that systemically enable a more efficient public procurement process, and at the same time provide a more economic operational implementation of a public procurement.
