Republika Filipini proti LR Kitajski

Abstract

Republika Filipini je 22. januarja 2013 v skladu s XV. delom in Prilogo VII h Konvenciji Združenih narodov o pomorskem mednarodnemu pravu (UNCLOS) sprožila arbitražni postopek proti Ljudski republiki Kitajski (LRK oz. Kitajska). Arbitraža se je nanašala na vlogo zgodovinskih pravic in vire pomorskih upravičenj v Južnokitajskem morju, pravni položaj nekaterih geografskih tvorb in njihova pomorska upravičenja ter protipravnost določenih dejanj s strani Kitajske. Na drugi strani je Kitajska vztrajno zavračala arbitražni postopek in vztrajala na stališču, da v njem ne bo sodelovala niti ga ne bo priznala. Arbitražni tribunal je dne 29. oktobra 2015 sprejel arbitražno odločbo o pristojnosti in dopustnosti in v njej zavrnil argumente Kitajske, da gre za spore v zvezi z ozemeljsko suverenostjo in določitvijo meje na morju. Postopek se je končal 12. julija 2016 z arbitražno odločbo o vsebini spora, v kateri je tribunal soglasno ugotovil, da so pretirani zahtevki Kitajske in z njimi povezane dejavnosti v Južnokitajskem morju v nasprotju s konvencijo in pomenijo njeno kršitev. Ne glede na odločbo arbitražnega tribunala o pomorskih upravičenjih Kitajske spor še vedno ni razrešen, saj Kitajska zavrača izvršitev arbitražne odločbe in vztrajno nadaljuje z gradbenimi aktivnostmi v Južnokitajskem morju.

Secondary abstract: On 22 January 2013, the Republic of the Philippines, pursuant to Part XV of and Annex VII to the United Nations Convention on the Law of the Sea (UNCLOS), initiated arbitration proceedings against People’s Republic of China (PRC). Arbitration concerned the role of historic rights and the source of maritime entitlements in the South China Sea, the status of certain maritime features and their maritime entitlements, and the lawfulness of certain actions by China. China, on the other hand, has consistently rejected the Philippines’ recourse to arbitration and adhered to the position of neither accepting nor participating in these proceedings. Arbitral tribunal on 29 October 2015 issued its Award on Jurisdiction and Admissibility and rejected China’s arguments that the dispute is about territorial sovereignty and maritime boundary delimitation. On 12 July 2016 arbitral tribunal issued a unanimous award in which it found China’s expansive maritime claims and actions related to it, in the South China Sea, to be inconsistent with, and in the breach of the Convention. Notwithstanding the decision of the arbitral tribunal on China’s maritime claims, the dispute remains unresolved, as China refuses to implement the award and continues with the construction activities in the South China Sea.
