Abstract
Evropsko sodišče za človekove pravice s sedežem v Strasbourgu je eno pomembnejših Sodišč s katerimi se zagotavlja uresničevanje temeljnih človekovih pravic in svoboščin. Ustanovljeno je bilo na podlagi Evropske konvencije o človekovih pravicah. Na Evropsko sodišče za človekove pravice se lahko pritoži vsaka država pogodbenica z državno pritožbo ali posameznik z individualno pritožbo, če menijo, da jim je bila kršena pravica določena s Konvencijo.
V diplomskem delu je predstavljeno Evropsko sodišče za človekove pravice, njegova organizacija in delovanje, postopek pred Sodiščem, ki se začne s pritožbo, nadaljuje z ugotavljanjem sprejemljivosti, obravnavanjem vsebine pritožbe do sodbe. Opisano je branje sodb ter njihovo izvrševanje. Jedro diplomskega dela sestavlja obravnava štirih primerov Slovenije pred Evropskim sodiščem za človekove pravice in sicer Milena Volk proti Sloveniji, Furman proti Sloveniji, Čeferin proti Sloveniji ter Vaskrsić proti Sloveniji.

The European Court of Human Rights with its seat in Strasbourg is one of the most important Courts, with which it is provided the realization of fundamental human rights and freedoms. It was established on the basis of the European Convention on Human Rights. Any Member State may appeal to the European Court of Human Rights with a state complaint or an individual with an individual complaint, if they consider that their rights from the Convention have been violated.
The diploma work presents the European Court of Human Rights, its organization and operation, proceedings before the Court, which starts with the appeal, continues with the determination of an acceptability, consideration of the content of the appeal to the judgement. The reading of judgements and their execution is described. The core of diploma consists of proceedings with four cases of Slovenia before the European Court of Human Rights; namely Milena Volk vs. Slovenia, Furman vs. Slovenia, Čeferin vs. Slovenia and Vaskrsić v. Slovenia. |
