Abstract

Izhodišča: Za zagotavljanje varne obravnave pacienta se v praksi zdravstvene nege uporabljajo tudi posebni varovalni ukrepi, z uporabo katerih pa zdravstveni delavci posegajo v temeljne človekove pravice in svoboščine. Raziskovalna metodologija in metode: Za oblikovanje teoretičnega dela smo uporabili deskriptivno metodo dela. V empiričnem delu smo kot raziskovalni inštrument uporabili anketni vprašalnik. Med zaposlene v zdravstveni negi v Splošni bolnišnici Celje smo razdelili 100 anketnih vprašalnikov, vrnjenih jih je bilo 97. Pridobljene podatke smo prikazali s pomočjo programa Microsoft Excel 2016 ter jih statistično obdelali s programom IBM SPSS 20.0. Rezultati: V raziskavi 26 % medicinskih sester navaja, da se med izvajanjem posebnih varovalnih ukrepov pogosto srečujejo s pravnimi in etičnimi dilemami. Zakonodajo, ki ureja uporabo posebnih varovalnih ukrepov v splošnih bolnišnicah, medicinske sestre slabo poznajo. Kar 41 % jih priznava, da niso seznanjene z Zakonom o duševnem zdravju iz leta 2008. Diskusija in sklep: Izvajanje posebnih varovalnih ukrepov predstavlja eno od najzahtevnejših nalog v zdravstveni negi. Pomembno je, da je njihova izvedba varna in kakovostna, obenem pa tudi skladna z veljavno zakonodajo in sprejetimi internimi akti delovne organizacije. Kakršnokoli odstopanje od veljavnih smernic in protokolov predstavlja podlago za moralno, etično in tudi pravno odgovornost zdravstvenih delavcev, ki izvajajo posebne varovalne ukrepe. Zato je nujno izobraževanje s področja njihove uporabe in zakonodaje, ki ga ureja.

Secondary abstract: Theoretical background: In order to ensure safe treatment of the patient, special protective measures are also in the practice of nursing care. With their use health workers interfere with the basic human rights and liberties. Research methodology and methods: To form the theoretical part, we used the descriptive method of work. We used a questionnaire as a research instrument in the empirical part. We distributed 100 questionnaires among the employees in the nursing care in General Hospital Celje. 97 were returned. Data was analysed using Microsoft Excel 2016 and IBM SPSS 20.0. Results: In the research, 26 % of nurses state that they often encounter legal and ethical dilemmas while performing special protective measures. Legislation which arranges their use in general hospitals is poorly known by nurses. As much as 41 % of them admit that they are not acquainted with the Mental Health Act of 2008. Discussion and conclusion: The implementation of special protective measures represents one of the most demanding tasks in health care. It is important that their performance is safe and quality and at the same time accordance with the applicable legislation and the adopted internal acts of the institution. Any deviation from the directives and protocols in force represents the basis for the moral, ethical and also legal responsibility of health workers which perform special protective measures. Therefore, education in the field of use of them and the legislation which regulates this field is urgent.
