Abstract

Pri odkrivanju in preiskovanju kriminalitete se policija vedno pogosteje srečuje s storilci, ki pri izvrševanju kaznivih dejanj uporabljajo različne elektronske naprave in medije. Elektronske komunikacije, predvsem svetovni splet in elektronska pošta, se zelo hitro širijo, pri svojih dejanjih pa jih uspešno uporabljajo tudi storilci kaznivih dejanj. Za učinkovito preiskavo je prav zato potrebno vse več znanja na tem področju kot tudi ustrezna tehnična opremljenost organov pregona. Na zakonodajnem področju se stanje v povezavi s proučevano tematiko nenehno spreminja, kajti proces globalizacije in s tem povezan razmah kriminala vedno znova odpirajo vedno nove pojavne oblike in razsežnosti kriminala. Na podlagi tega se spreminjajo tudi pristopi in pristojnosti policistov ter kriminalistov, ki te pojave preiskujejo. Predvsem pa je pomembno, da razvoju tehnologije in načinu izvrševanja kaznivih dejanj sledi tudi zakonodaja in tako omogoči učinkovito preiskavo in pregon kaznivih dejanj. Pomembnost problematike se močno odraža v številnih prvinah, vsebovanih v normativno-pravnih aktih na področju dela pravosodja in policije, tako na evropski kot tudi nacionalni ravni. Slovenska zakonodaja se na področju zasebnih komunikacij bistveno ne razlikuje od zakonodaje v drugih evropskih državah, hkrati pa je sodna praksa glede odreditve prikritih preiskovalnih ukrepov in pridobitve izpisa telekomunikacijskega prometa zelo odvisna od stališča posameznega preiskovalnega sodnika. Običajno ti sledijo predlogu državnega tožilca, v posameznih primerih pa se preiskovalni sodnik odloči predlog zavrniti. Preiskava elektronskih naprav zagotovo pomeni velik poseg v ustavno zagotovljeno pravico posameznika do zasebnosti in prav zato zahteva jasno določenost v zakonu in močno pravno varstvo. Vedno nove razsežnosti in oblike kriminalitete terjajo uvajanje novih rešitev in tehtanje med učinkovitostjo pregona in varovanjem prekomernih posegov v pravice posameznika.

Secondary title: The importance of the electronic communiaction data for the criminal investigation
Secondary abstract: In the detection and investigation of crime, police are increasingly encountering perpetrators who use various electronic devices and media when committing criminal offenses. Electronic communications, especially the Internet and e-mail, are spreading rapidly, and they are successfully used by criminals in their actions. Effective investigation requires more and more knowledge in this area, as well as adequate technical equipment of law enforcement agencies. In the legislative field, the situation is constantly changing in connection with the topic examined, because the process of globalization and the related rampant crime are always opening up new forms and dimensions of crime. On this basis, the approaches and responsibilities of police officers and criminals who investigate these phenomena are changing. Above all, it is important that the development of technology and the form of carrying out crime are also followed by legislation, thus allowing effective investigation and prosecution of criminal offenses. The relevance of the issue is strongly reflected in a number of elements contained in normative-legal acts in the field of justice and police work, both at European and national level. Slovenian legislation does not significantly differ from the legislation in other European countries in the field of private communications, and the case-law on the ordering of covert investigative measures and the acquisition of the telecommunication traffic report are highly dependent on the stance of the individual investigating judge. They usually follow the proposal of the state prosecutor, but in individual cases the investigating judge decides to reject the proposal. The investigation of electronic devices certainly signifies a major interference with the constitutionally guaranteed right of the individual to privacy and it therefore requires precise legal definition and strong legal protection. Constantly new dimensions and forms of criminality require the introduction of new solutions and the weighing between law enforcement efficiency and safeguarding excessive interference with individual rights.
