Abstract

Pravica do izobraževanja je ena temeljnih človekovih pravic, ki jo kot takšno priznavajo številni nacionalni, regionalni in mednarodni pravni dokumenti, njeno uresničevanje pa spodbujajo in nadzorujejo številne pomembne mednarodne organizacije ter civilna družba. Magistrsko delo si prizadeva s celostnim pristopom obširno in natančno preučiti pravico do izobraževanja, tako iz pravno-teoretičnega kot praktičnega vidika, pri čemer se v geografskem smislu o meji in osredotoči na države Evrope. Prvi -teoretični del magistrske naloge opredeli pojem,vsebino in pomen pravice do izobraževanja, njene najpomembnejše regionalne in mednarodne pravne vire ter delo mednarodnih organizacij na tem področju. V drugem - praktičnem del upa magistrska naloga prek konkretnih primerov izpostavi izzive in težave, s katerimi se evropske države soočajo pri uresničevanju pravice do izobraževanja v praksi, pri čemer podrobneje preuči področja obveznosti primarnega izobraževanja, financiranja in privatizacije izobraževanja, pravic staršev v zvezi z izobraževanjem njihovih otrok in pravic posameznih ranljivih skupin (invalidov, Romov, narodnih in jezikovnih manjšin ter beguncev) na področju izobraževanja. Vse ugotovitve so v zaključku strnjene v sklepno misel o tem, kako vestno in učinkovito se v Evropi uresničuje pravica do izobraževanja in kaj evropskim državam pri tem predstavlja poseben izziv.

Secondary abstract: The right to education is one of the fundamental human rights, recognizedby a number of national, regional and international legal documents. Its implementation is promoted and monitored by a number of important international organizations, as well as civil society. The master's thesisuses a holistic approach to examine the right to education in an extensive and precise way, both from theoretical and practical point of view, while focusing on the countries of the European region. The first - theoretical part of the master's thesis defines the concept, the contentand the meaning of the right to education, presents its most important regional and international legal sources and the work of international organizations in the field. The second - practical part of the master's thesis studies specific cases to highlight the challenges and difficulties the European countries face when trying to fully realize the right to education in practice. The thesis takes a close look at different aspects of the right to education, such as the obligation of primary education, the funding and the privatization of education, the rights of parents regarding the education of their children and the rights of specific vulnerable groups (persons with disabilities, Roma, ethnic, linguistic minorities and refugees) in the field of education. All findings are summarized in a final conclusion on how effectively the right to educationis realized in Europe and what particular challenges the European countries are facing when trying to fully implement this right.
