Abstract

Avtorska pravica, ki je del širše pravice intelektualne lastnine, je urejana v Zakonu o avtorski in sorodnih pravicah (ZASP), prav tako pa sodi med ustavno varovane pravice. Avtorska pravica nastane sočasno z nastankom avtorskega dela. Obstoj avtorske pravice je vezan na avtorsko delo, tako da s samim obstojem ali neobstojem avtorskega dela stoji in pade celoten sistem avtorskopravnega varstva. Pri avtorskem delu gre za individualno intelektualno stvaritev s področja književnosti, znanosti in umetnosti, ki mora biti na kakršenkoli način izraženo. Da gre pri določeni stvaritvi za avtorsko delo, morajo biti izpolnjene določene predpostavke:stvaritev konkretnih oseb, področje ustvarjalnosti, duhovnost, individualnost in izraženost.Med avtorska dela pa sodijo tudi novinarski prispevki, če izpolnjujejo zgoraj navedene predpostavke. Moja prva hipoteza je, da so prav vsi novinarski prispevki enako zaščiteni z vidika avtorske pravice. Avtorska pravica pogosto trči ob pravice in interese drugih, zato je zakonodajalec v določenih primerih, ki se mu zdijo najbolj relevantni za varovanje temeljnih družbenih vrednot, vzpostavil institut omejitve avtorske pravice. V praksi ni redek pojav, da določeni subjekti reproducirajo že objavljene novinarske prispevke v svojih medijih oziroma na svojih spletnih straneh s tem, da navedejo vir prvotne objave, avtorja prispevka ter morebitnih fotografij. Takšno kopiranje in lepljenje predhodno objavljenih prispevkov, ki mu strokovnjaki pravijo kliping, pomeni velik ekonomski potencial. V diplomskem delu se ukvarjam z vprašanjem, kako je s sekundarnim reproduciranjem novinarskih prispevkov, zlasti z vidika avtorske pravice. Moja druga hipoteza je, da kliping v slovenskem pravu ni urejen.

Secondary abstract: Copyright, which is part of the intellectual property right, is editedin Copyright and Related Rights Act. Furthermore, copyright is constitutionally protected right. Copyright is formed contemporarily with formation of copyrighted work. The existence of copyright is involved in the copyrighted work, so with the existence or non-existence of copyright work, stands or falls the whole system of the copyright protection. Together with the copyright work come individual and intellectual creations from the field of literature, art and sciences, that should be in any way expressed. Moreover, to label certain creation for copyrighted work, it has to fulfill the following assumptions: the creation of concrete persons, the field of creativity, spirituality, individuality and expressiveness. The copyright works include journalistic contributions only if journalistc contributions fulfill the above assumptions. My first hypothesis is that all journalistic contributions are equally protected by the terms of copyright. Copyright often hits rights and interests of others. Therefore, the legislator has, in certain cases, which he considers the most relevant for the protection of fundamental social values, established the restrictions of copyright. Practice showed that it is not a rare phenomenon that certain entities reproduce previously published journalistic articles in their media or on their websites by indicating the source of the original publication, author contribution and potential photos. Such copying and pasting of previously published contributions, which experts named clippings, means a large economic potential. In this work I will deal with the question of how is it with the secondary reproduction of journalistic contributions, particularly inregard to copyright.My second hypothesis is that clipping in the slovenian law is not regulated.
