Abstract

Magistrsko delo predstavlja ustavni položaj nepriznanih držav, ki so zaradi konfliktnosti izvor številnih kršitev človekovih pravic. Sistematično in analitično predstavlja mednarodno pravo in priznanje države. Opredeljuje nastanek in priznanje države. Poudari temeljne pravice držav, ki izvirajo iz mednarodnega pravnega reda,in pomen suverenosti oz. njene odsotnosti v nepriznani državi. V okviru zasnove nepriznane države obravnava teorijo nepriznanih držav, suverenost, separatizem in politično ekonomijo. Glede na to, da nepriznane države predstavljajo zapleten politični in ozemeljski problem,je v delu poudarjena kompleksnost nepriznane države v svetovnem merilu in prizadevanje mednarodne skupnosti za priznanje nepriznanih entitet v države, posledično pa zmanjševanje kršitev človekovih pravic.Pri tem velja poudariti pravne akte o ureditvi človekovih pravic in vlogo Evropske unije, Sveta Evrope pri varovanju človekovih pravic v nepriznanih državah na ozemlju Evropske unije. Na območju nepriznanih držav v Afriki in na Kitajskem, kjer ni pričakovati vpliva Evropske unije in Sveta EU, se pojavlja vprašanje, s katerimi ukrepi zagotoviti učinkovito varstvo človekovih pravic v ustavno nepriznanih državah in kako zagotoviti suverenost teh držav.V magistrski nalogi je na primeru štirinajstih nepriznanih držav predstavljena ustavna ureditev človekovih pravic in temeljnih svoboščin. Za pretežni del pa tudi kršitve temeljnih pravic in svoboščin, ki se najpogosteje pojavljajo.

Secondary abstract: The master's thesis presents constitutional status of unrecognized countries, which are a source of numerous human rights violations due to their conflict nature. It systematically and analytically presents international law and recognition of a country. It defines the formation and recognition of a country.The thesis emphasizes counties' fundamental rights, which originate from international legal order, and the importance of sovereignty or absence of it in an unrecognized county. It addresses the theory of unrecognized countries, sovereignty, separatism and political economy within the concept of unrecognized country. Given the fact that unrecognized countries represent a complex political and territorial issue, the thesis highlights complexity of an unrecognized country on a global scale and the efforts of international community for recognition of unrecognized entities into countries, and consequently reducing the number of human right violations. When discussing the matter,the human rights act and role of the European Unionand the Council of Europe in protecting human rights in unrecognized countries within the European Union territory, should be emphasized. In the area of unrecognized countries in Africa and China, where there is no expected influence of the European Union and the Council of Europe, there is a question of which measures could ensure efficient protection of human rights in constitutionally unrecognized countries, and how to ensure the sovereignty of these countries.The master's thesis presents constitutional regulation of human rights and fundamental freedoms, using the example of fourteen unrecognized countries. For the major part it also presents the violations of fundamental rights and freedoms that occur most frequently.
