Abstract

Koncept imperativnih občih norm mednarodnega prava ali tako imenovani jus cogens je kljub dolgoletnim razpravam še vedno aktualna problematika mednarodne pravne doktrine. Obstoj norm, ki so izven dispozitivne volje posameznih držav, izražene v formalnih virih mednarodnega prava, je bistvo problematike jus cogens. Dunajska konvencija o pravu mednarodnih pogodb je poglavitni institut, ki je uvedel omenjeni koncept v pozitivnopravno mednarodno okolje, vendar pa ni dosegel svojega namena, saj ostajajo odprta vprašanja glede narave koncepta, njegove vsebine ter učinkovanja. Komisija za mednarodno pravo je organ OZN, ustvarjen za pravno kodifikacijo in progresivni razvoj mednarodnega prava. Del mednarodne pravne doktrine trdi, da je s svojim delom uvedla jus cogens v pozitivno mednarodno pravo in da njen Osnutek konvencije o pravu mednarodnih pogodb predstavlja progresivni razvoj mednarodnega prava. Določitev same vsebine koncepta jus cogens se zaradi nepopolnosti tako prepušča praksi držav in mednarodni judikaturi, predvsem Meddržavnega sodišča v Haagu.

Secondary abstract: The concept of universal peremptory norms of international law, or jus cogens, despite long-standing debate, is still a current issue in the international doctrine. The existence of norms which are outside the discretionary will of individual countries, expressed in formal sources of international law is the essence of the issue of jus cogens. The Vienna Convention on the Law of Treaties is the main institute which introduced the aforementioned concept to the positive international law environment. However, the latter did not achieve its purpose, as questions about the nature of the concept, its content and effects remain. The Interntional Law Commission is a UN body created for legal codification and the progressive development of international law. Part of the international legal doctrine maintains that with its work it introduced jus cogens into positive international law and that its Draft Convention on the Law of Treaties constitutes a progressive development in international law. Due to it incompleteness, determining the content of the concept of jus cogens is left to the practice of countries and international courts, in particular the International Court of Justice.
