Abstract

Arbitraža je način zunajsodnega reševanja sporov in je poleg mediacije in konciliacije eden od alternativnih načinov reševanja sporov. Arbitraža se od mediacije in konciliacije razlikuje v tem, da je njena končna odločitev za stranke obvezujoča. Prednost arbitraže je v možnosti vpliva na postopek in predmet odločanja. Stranke sklenejo arbitražni sporazum, v katerem določijo pristojnost in sedež arbitraže, izbor arbitrov, potek postopka in merodajno pravo. Druge prednosti arbitraže so še večja hitrost, nejavnost in učinkovitost postopka in strokovnost izbranih arbitrov. Ker gre pri arbitraži za vrsto zasebnega sodišča, se pojavi vprašanje o pravni naravi arbitražnih odločb. Za te velja, da so zavezujoče, izvršljive pa postanejo, ko jih kot take v postopku eksekvature potrdi pristojno sodišče. Diplomska naloga obravnava priznanje in izvršitev arbitražnih odločb. Predvsem se osredotoča na priznavanje in izvršitev tujih arbitražnih odločb, za priznanje katerih Zakon o arbitraži neposredno napotuje na pravila Newyorške konvencije. Ta v svojih določbah podpisnice obvezuje, da tuje arbitražne odločbe priznajo in pri tem ne postavljajo strožjih pogojev, kot veljajo za priznanja domačih. Konvencija pa pod določenimi pogoji tudi dopušča, da se priznanje in izvršitev tuje arbitražne odločbe lahko zavrne.

Secondary abstract: Arbitration (ADR) is, beside mediation and conciliation, a form of alternative dispute resolutions. The fact that arbitration is a binding process sets it apart from mediation and conciliation and as well as the fact that the parties are free to agree how the disputes are resolved sets it apart from litigation. The scope of arbitration, the use of arbitration rules, the seat of arbitration, the method of appointment of the arbitrators and the choice of law applied are usualy addressed by arbitration agreements. The other pros of arbitration are speed of proceedings, privacy and expertise of the arbitrators. Since arbitration is a private determination of disputes, doubts might arise concerning legal consequences of the arbitration awards. Allthough they indeed are analogous to court judgements, they are to be authorised by the court. This thesis focuses on recognition and enforcement of arbitration awards, namely foreign awards. The Slovenian Arbitration Act stipulates that the New York Convention is to be applied for recognition and enforcement of foreign awards. Provisions of the New York Convention provide rules for recognition of foreign arbitration awards and also forbid signatory states from imposing more onerous conditions for recognition of foreign awards to the ones regarding recognition and enforcement of domestic awards. Convention also stipulates that recognition and enforcement can be denied, provided the party against whom it is invoked can provide proof for major fails stipulated in article V.
