Abstract

Za razliko od slovenskega prava upravni postopek pred Evropsko komisijo ni kodificiran. Zaradi tega ima sodna praksa Sodišča EU izreden pomen pri uveljavljanju klasičnih institutov upravnega postopka. Avtor ugotavlja, da se v upravnem postopku pred Evropsko komisijo upoštevajo številni elementi, ki so vsebovani tudi v slovenskem Zakonu o splošnem upravnem postopku, kot so npr. pogoji za uvedbo postopka, preiskovalno načelo, načelo materialne resnice, pravica stranke do izjave, neodložilni učinek pravnih sredstev idr. Ker se postopek pred Evropsko komisijo na področju konkurenčnega prava lahko konča tudi s sankcijami, je sodna praksa v upravni postopek uvedla posamezna načela kazenskega prava (načela nullum crimen sine lege, ne bis in idem, nemo tenetur, domneva nedolžnosti).

Secondary title: Analysis of some aspects of procedural rules in administrative proceedings for infringement of competition law before the European Commission
Secondary abstract: By opposition to Slovenian law administrative proceedings before the European Commission do not have a codified set of rules. Such a finding implies enormous importance of case law of the Court of Justice of the European Union for application of classical institutes of administrative law. Administrative proceeding before the Commission comprises several elements also known in Slovenian administrative law (condition for initiating administrative proceedings, principle inquisitoire, principle of substantive truth, right to be heard, judicial remedies do not have a suspensory effect etc. As administrative proceedings in competition matters before the European Commission may lead to certain sanctions, case law introduced principles of criminal law (principles nullum crimen sine lege, ne bis in idem, nemo tenetur, presumption of innocence) in administrative proceedings.
