Abstract

Namen diplomskega dela je predstaviti institut posvojitve in preveriti, kako je z varovanjem koristi otroka v tem postopku. Posvojitev je pravni akt, ki je prisoten skozi celotno zgodovino. Dojemanje in pojmovanje posvojitve se je skozi čas spreminjalo in danes smo še vedno priča številnim težavam in preprekam na poti do posvojitve. Z modernizacijo družbenih odnosov je prišlo do sprememb tudi na področju družinskega prava in s tem instituta posvojitev. Na področju posvojitev je najaktivnejši center za socialno delo (v nadaljevanju CSD), v njegovi senci pa v določenih primerih odločajo sodišča. Ne glede na to, kateri organ deluje v postopku, je v ospredju vedno otrokova korist, ki mora biti vodilo v vseh postopkih. V praksi se soočamo s številnimi težavami in preprekami skozi postopek posvojitve, ki je dolg in zahteven za posvojitelja. Področje poleg notranje zakonodaje urejajo tudi mednarodne konvencije. Te urejajo tako postopek kot tudi varovanje otrokovih koristi.

Secondary abstract: The purpose of present diploma paper is to present the institution of adoption and examine how the child's interest is protected during the adoption process. Adoption is a legal act present throughout history. Perception and comprehension of adoption changed with time and today we still witness many problems and obstacles on a way to adoption. The modernisation of social relations brought changes in the field of family law and the institution of adoptions. The most active in the field of adoptions is a social work centre (hereinafter: SWC), but in some cases the decision is made by courts. Irrespective of which authority acts in the process, the child's interest is in the foreground and must be a guide in all processes. In practice we face many problems and obstacles in the process of adoption, which is long and demanding for the adoptive parent. Beside national legislation, the subject is regulated by international conventions as well. Those regulate the process itself and the protection of child's interests.
