Abstract

Jedro diplomskega dela tvori predstavitev ureditve preiskovalnih dejanj pri odvetnikih in tisti del predloga Zakona o spremembah in dopolnitvah Zakona o kazenskem postopku, ki se nanaša nanje. Spremembe in dopolnitve Zakona o kazenskem postopku je zakonodajalcu naložilo Ustavno sodišče, ki je ugotovilo njegovo neustavnost. Zakonska ureditev, ki je veljala do odločbe Ustavnega sodišča, je omogočala široko in obsežno dostopanje preiskovalcev do podatkov in je tako protiustavno posegala v odvetniško zasebnost. Zaradi osvetlitve in razumevanja obravnavane tematike je na začetku diplomskega dela na kratko predstavljeno odvetništvo s poudarkom na načelu zaupnosti razmerja med odvetnikom in stranko. Predstavljena je tudi ureditev preiskovalnih dejanj pri odvetnikih pred sprejemom odločbe Ustavnega sodišča, v nadaljevanju dela pa je podrobno predstavljena tudi odločba. Ker se je do vprašanj, ki se nanašajo na preiskovalna dejanja pri odvetnikih, večkrat opredelilo tudi Evropsko sodišče za človekove pravice, je eno poglavje dela posvečeno predstavitvi sodne prakse na tem področju ter meril in pogojev za dopustnost preiskovalnih dejanj pri odvetnikih, ki jih je opredelilo to sodišče. Diplomsko delo obsega tudi kratek pregled ureditve preiskovalnih dejanj pri odvetnikih v nekaterih drugih državah. Sklepni del diplomskega dela je namenjen podrobni predstavitvi in obrazložitvi predlagane zakonske rešitve ter ugotovitvam, ali ta predstavlja zadosten korak naprej na tem področju. Prispevek predstavlja celoten pregled ureditve preiskovalnih dejanj pri odvetnikih, tako z vidika odločbe Ustavnega sodišča in sodne prakse Evropskega sodišča za človekove pravice kot z vidika predlagane zakonske rešitve.

Secondary abstract: The core of the thesis comprises the presentation of investigative actions at attorneys and that part of the proposal of the Act Amending the Criminal Procedure Act, which refers to that actions. The amendments and supplements to the Criminal Procedure Act were imposed on the legislator by the Constitutional Court who found the Criminal Procedure Act to be unconstitutional. The statutory regulation which was in force until the Constitutional Court's decision enabled a broad and extensive access of the investigators to the data and thus unconstitutionally interfered with the attorney's privacy. Due to the illumination and understanding of this topic, the introduction of thesis briefly presents the attorney's profession. The emphasis is placed on the principle of confidentiality of the relationship between a lawyer and his client. The thesis also presents the regulation of investigative actions at attorneys before the adoption of the decision of the Constitutional Court as well as detailed analysis of Constitutional Court's decision. Since the European Court of Human Rights has repeatedly referred to questions relating to investigative acts at attorneys, one chapter of thesis is dedicated to some of its decisions. The same chapter also includes presentation of the criteria and conditions for the admissibility of investigative actions at attorneys. The thesis also includes a brief overview of the regulation of investigative actions at attorneys in some other countries. The final part is dedicated to detailed presentation and explanation of the proposed legal solution and for determining whether or not the proposed legal solutions are in fact a sufficient step forward for the discussed matter. The thesis presents a complete overview of the regulation of investigative acts at attorneys, both from the perspective of the decision of the Constitutional Court and the case law of the European Court of Human Rights, and from the aspect of the proposed legal solution.
