Abstract

Dobra komunalna infrastruktura, vodovod, kanalizacija, elektrika, plinovodi, ceste in ostale javne storitve so pogoj za kvalitetno življenje vsakega posameznika in skupnosti, v kateri posameznik biva in dela. Bolj kot je infrastruktura razvita, boljši je osebnostni in gospodarski razvoj te skupnosti. Osnovna infrastruktura se zagotavlja že na primarni lokalni ravni in nato nadgrajuje na državni ravni. Za razvoj nove infrastrukture in boljše javne storitve pa je potreben poseg v stvarne pravice. Pravica do lastnine je ena od najpoglavitnejših človekovih pravic. Tako se posameznik znajde v situaciji, ko mora pretehtati, ali dovoli poseg v svoje pravice, v svojo lastnino. Naj s posegom soglaša in sprejme odškodnino? Bo ta odškodnina pravična? Kaj se bo zgodilo, če soglasja ne bo in bo država s svojimi postopki posegla v naše pravice? V magistrski nalogi sem predstavila postopke in pravne podlage prostovoljne in prisilne razlastitve. Analizirala sem transparentnost teh postopkov. Izpostavila sem prednosti in pomanjkljivosti teh postopkov, dileme, s katerimi se v praksi srečujejo udeleženci v teh postopkih in na katere opozarjajo pravniki v svojih strokovnih člankih.

Secondary abstract: Good utility infrastructure, water supply, sewerage, electricity, pipelines, roads and all other public services are a must for a quality life of every individual in a community, in which the individual lives and works. The more the infrastructure is developed the better is the personal and economic development of the community. Basic infrastructure is provived on the primary local level and it than upgrades on the state level. To develop a new infrastructure and better public services. For structural development and for better public services an intervention in basic rights is needed. The right of property is one of the most importnat human rights. That is how an individual gets himself in a situation in which he must consider if he allows an intervention in his rights or his property, if he wants to agree with the intervention or accept the compensation? Will the compensation be righteus? What will happen if there will be no consensus and the state will intervend in our rights wither their processes? In this Master htesis i have represented processes and legal basis of voluntary and forced expropriation. I have analised transparecy of these processes. I Have exposed pros and cons of these processes, dilemma swhich are encountered by the participants in these processes and which are being warned of by lawyers in their professional papers
