kritična analiza normativne ureditve
Abstract
Po osamosvojitvi Republike Slovenije je mlada država potrebovala novo zakonodajo, ki bi bila sodobnejša in učinkovitejša. Eno večjih sprememb na pravnem področju je doživela prekrškovna zakonodaja, ko je bil sprejet nov sistemski zakon - Zakon o prekrških (ZP-1), ki je celovito prenovil področje prekrškov. ZP-1 je uvedel nove postopke odločanja o prekršku, nove institute in nove organe, ki odločajo v postopku o prekršku. Ena izmed značilnosti, ki jih je uvedel ZP-1 je t.i. hitri prekrškovni postopek, ki ga vodijo prekrškovni organi. Tak postopek naj bi bil predvsem hiter, enostaven in učinkovit. Že takoj po sprejemu ZP-1 so se pokazale določene težave, tako pri izvajanju zakona, kot tudi njegovem tolmačenju, zato je bil ZP-1 od sprejema že (pre)večkrat spremenjen. Zaradi njegovega pogostega spreminjanja je prekrškovni postopek postal prezapleten in nejasen, tako za tiste, ki ga izvajajo, kot tudi za kršitelje. Namen magistrske naloge je pripraviti pregled materialnopravne in procesnopravne ureditve hitrega prekrškovnega postopka in skozi pregled ureditve podati kritiko hitrega prekrškovnega postopka ter kritiko prekrškovne zakonodaje z vidika uporabe v policiji. Kritična analiza normativne ureditve je narejena v luči policijskega dela in izhaja iz predpostavke, da pri prenovi prekrškovne zakonodaje niso bila upoštevana vsa pravna načela.

After gaining independence, the Republic of Slovenia needed new, contemporary and more efficient legislation. Some of the greatest changes were made to the minor offences legislation where a completely new systemic law was adopted - the Minor Offences Act (ZP-1), that completely recast the subject of misdemeanours. The Minor Offences Act imposed new decision procedures, new legal concepts and new organs that are the decision making bodies in the minor offence procedure. One of the features introduced by the ZP-1 is the so-called quick misdemeanour proceeding led by the misdemeanour authority. Such a proceeding is mostly meant to be fast, simple and efficient. However, immediately after adopting the ZP-1, certain difficulties appeared with the actual implementation of the law as well as with its interpretation, which led to several changes of the law. Due to the repeated changes, the quick misdemeanour proceeding became overly complicated and unclear, for those who implement it as well as the infringers. The purpose of this Master's thesis is to prepare an overview of the substantive and procedural legal arrangement of the quick misdemeanour proceeding and at the same time provide a critique of the quick misdemeanour proceeding as well as of the minor offences legislation from the point of view of its practical use in the police force. The critical analysis of the regulatory framework is done in the light of police work and is based on the assumption that the recasting of the minor offences legislation failed to use all legal principals. |
