Abstract

Dokazni postopek je sredstvo, s katerim stranki uveljavljata svoje zahteve in verzije. Bistvo je razmerje med posameznikom in državo, ki pa mora biti enakopravno. Bistvo ekskluzije je, da prepreči, da bi se nezakonito pridobljeni dokazi uporabili v kazenskem postopku. V primeru uporabe takih dokazov, gre za kršenje človekovih pravic in temeljnih svoboščin in pa tudi procesne kršitve. Pojem ekskluzija dokazov izvira iz Združenih držav Amerike in je tam tudi najdosledneje izpeljan. Slovenija in ZDA imata v nekaterih primerih podobno ureditev, vendar pa obstajajo tudi tiste ključne razlike med njima.

Secondary abstract: The evidence hearing is an instrument by which the parties enforce their requirements and versions. The main purpouse of the exclusion of evidence is providing not to use evidence in court if there are violated human rights. The evidence can also not be used if it means violating procedural. Exclusion of evidence have source from United States of Amerika. Slovenia and US have in some cases very similar regulation, but there are also some main diferences between them.
