Abstract

Namen diplomskega dela je raziskati in analizirati pravno ureditev položaja otroka in varovanja njegove koristi ob razvezi zakonske zveze. Korist otroka se konkretizira s pomočjo zakona in z upoštevanjem vseh okoliščin nekega konkretnega primera. V njegovo korist morajo delovati tako starši kot tudi druge osebe, državni organi ter nosilci javnih pooblastil. Pravo zahteva od države, da spoštuje pravice in dolžnosti staršev ter jim zagotovi primarno vlogo pri skrbi za razvoj in vzgojo otroka. Država sme v ustavno varovane starševske pravice posegati samo takrat, ko to zahteva varovanje otrokove koristi, ob tem pa mora upoštevati vnaprej določene pogoje in zakonsko predpisane postopke. Sodišče ob razvezi zakonske zveze pogosto odloča o sporih iz razmerij med starši in otrokom, ki se nanašajo na vzgojo in varstvo otroka, njegovo preživljanje in stike, ki naj bi jih imel s staršem, s katerim po razvezi zakonske zveze ne bo več živel. Otroku se mora omogočiti, da izrazi svoje mnenje o vseh vprašanjih, ki ga neposredno zadevajo, če je dovolj zrel in sposoben razumeti dogajanje in posledice svojih ravnanj. Upoštevanje otrokove volje je v končni fazi odvisno od njegove zrelosti in pomembnosti same obravnavane sporne zadeve.

Secondary abstract: The purpose of this diploma thesis is to research and analyze the legal system regarding the position of a child and protecting its interests in the process of divorce. To provide the child's best interests, it is necessary to follow the law and consider all of the circumstances of a case. Parents, state authorities and public representatives have to work in the best interest of the child. The law assures that the state respects parents' rights and obligations and that parents have the primary role, when itcomes to raising and taking care of the child. The state cannot interfere with parental rights, which are protected by the constitution, unless it is for the better of the child. Even then it has to consider the conditions, set in advance, and procedures,defined by the law. Courts often have to decide in disputes regarding raising, supporting, taking care of the child and contacts with the parent that no longer lives with the child after the divorce. The child needs to have an opportunity to tell its opinion about the issues, concerning it, if it is mature enough to understand the situation and the consequences of its actions. Respecting the child's wishes depends on the maturity of the child and on the seriousness of the issue.
