Abstract

Namen te diplomske naloge je raziskati mednarodno arbitražo kot eno od sredstev za mirno reševanje mednarodnih sporov ter preučiti njene temeljne značilnosti.Začetek diplomskega dela se osredotoča na mednarodno pravo na splošno ter na diplomacijo kot sredstvo zunanje politike in predstavi relevantne organe na tem področju.V nadaljevanju je predstavljeno področje mirnega reševanja sporov s podatki o diplomatskih in pravnih sredstvih mirnega reševanja mednarodnih sporov. Poleg tega vsebuje kratek zgodovinski pregled ter opis enega od temeljnih načel mednarodnega prava - dolžnost mirnega reševanja sporov. Zatem se diplomsko delo osredotoča na mednarodno arbitražo. Spoznamo oblike le-te,njeno pravno naravo, način sestave arbitrov in značilnosti arbitražnega postopka. Kratek del je namenjen Vzorčnemu zakonu o mednarodni trgovinski arbitraži, konec diplomskega dela pa je posvečen Stalnemu arbitražnemu sodišču, kije pomembno prispeval k razvoju mednarodnega prava.

Secondary abstract: The purpose of this thesis is to explore international arbitration as one of the methods of a peaceful settlement of international disputes. In the beginning it focuses on international law in general and also diplomacy as an important part of country`s foreign policy. There we find information on its most relevant organs. Further on it touches the areaof peaceful settlements of international disputes where one can learn about its main categories and characteristics. Besides that, it contains a short description of its history and presentation of one ofthe fundamental law principles, where it states thatall members of United Nations must settle their international disputes by peaceful means. After that, the focus shifts oninternational arbitration, where one canlearn about itsmain classifications, juridical nature, ways of compositing an arbitrary tribunal, and other features of an arbitrary procedure. A short part of this work also focuses on Model law on International Commercial Arbitration and in the end concludes with a chapter about Permanent Court of Arbitration that greatly contributed to the development of international law.
