Abstract

Diplomsko delo obravnava postopek podelitve policijskih pooblastil Slovenski vojski. Dotika se begunske mejne problematike, ki je bila povod za nastanek neobvladljivih varnostnih razmer na področju državnih meja. V skladu s tem diplomsko delo predstavlja potek, vodila in argumentacijo predlagateljev sprememb Zakona o obrambi ter nasprotnikov sprejetih sprememb in njihovo pobudo za razpis zakonodajnega referenduma. Največji poudarek je na analiziranju vsebine Zakona o dopolnitvi Zakona o obrambi in razlaganju obsega in umestitve policijskih pooblastil. Ker je po sprejetju zakona, ki Slovenski vojski podeljuje izjemna pooblastila, prišlo do postopka za oceno ustavnosti, so v diplomskem delu jasno razdelani argumentacija predlagatelja zahteve, odgovor Ustavnega sodišča in odklonilno ločeno mnenje dveh ustavnih sodnic glede vprašanja neskladja 37.a-člena Zakona o obrambi z Ustavo RS.

Secondary abstract: This diploma thesis deals with the procedure of conferring police powers to the Slovenian Armed Forces. It concerns refugee border problems, which gave rise to the occurrence of an uncontrollable security situation at the national borders. Accordingly, this diploma thesis presents the course, the considerations and the argumentation of the proposers of changes to the Defence Act, as well as those of the opponents of the adopted changes and their initiative to call a legislative referendum. The major emphasis has been placed on the analysis of the Act on amending the Defence Act, and the interpretation of the scope and integration of the police powers. Since a constitutional review procedure was initiated after the passing of the Act, which awards exceptional powers to the SAF, the diploma thesis clearly elaborates the argumentation of the request proposer, the answer of the Constitutional Court and a dissenting opinion of two Constitutional Court judges regarding the issue of contradiction between Article 37.a of the Defence Act and the Constitution of the Republic of Slovenia.
