Abstract
V diplomski nalogi je predstavljen institutupravni spor skozi vidik slovenske in evropske zakonodaje.Upravni spor predstavlja sodno varstvo pravic in pravnih koristi fizičnih in pravnih oseb proti odločitvam in dejanjem državnih organov, organov lokalne skupnosti ter nosilcev javnih pooblastil. V upravnem sporu se presoja o zakonitosti dokončnih upravnih aktov, posamičnih aktov in dejanj, ki posegajo v človekove pravice, aktov volilnih organov in drugih aktov, če tako določa zakon. Upravni spor ni dopusten v primeru,da je stranka imela možnost vložiti pritožbo ali drugo pravno sredstvo zoper upravni akt, pa tega ni storila oziroma ga je vložila prepozno. Opustitev oziroma zamudo vložitve pravnega sredstva se sankcionira z izgubo pravice do upravnega spora.Upravni spor je subsidiarno pravno sredstvo v primeru posamičnih dejanj in aktov, s katerimi se posega v ustavne pravice posameznika, če ni zagotovljeno drugo sodno varstvo. Gre za posamične akte in dejanja, s katerimi organi posegajo v človekove pravice in temeljnesvoboščine posameznika. Na prvi stopnji v upravnem sporu odloča pristojno Upravno sodišče Republike Slovenije, na drugi pa Vrhovno sodišče Republike Slovenije. Sedež Upravnega sodišča je v Ljubljani, sodi pa tudi na zunanjih oddelkih: "Celje, Nova Gorica in Maribor".Stranka, ki je v svoji državi izčrpala vsa pravna sredstva, lahko zoper upravni akt vloži še pritožbo na Evropsko sodišče za človekove pravice. Pogoj za vložitev pritožbe na ESČP je navedba stranke, da ji je s pravnomočnim upravnim aktom kršena pravica, ki ji je zagotovljena po Evropski konvenciji o varstvu človekovih pravic in temeljnih svoboščin. V upravnih zadevah pride največkrat do kršitve 6. člena Konvencije - pravica do sojenja v razumnem roku.

In the diploma thesis the institute of administrative dispute through the perspective of Slovene and European legislation is presented. Administrative dispute represents judicial protection of the rights and legal entitlement of natural person and legal person against the decisions and actions of authorities of the state, local community authorities as well as bearers of public authorities. In administrative dispute the regularity of final administrative acts, individual acts, and other acts, if so stipulated by law, are judged. Administrative dispute is not permissible in case if the party had an opportunity to file a complaint or other judicial remedy against the administrative act, but did not do so or it lodged an appeal too late. Omission or delay of lodging of a legal remedy is sanctioned with the loss of the right to an administrative dispute. An administrative dispute is a subsidiary judicial remedy in case of individual actions and acts, being prejudicial to the rights of an individual if no other judicial protection is ensured. These are individual acts and actions, by which institutions are prejudicial to human rights and fundamental freedoms of an individual. In the first instance of the administrative dispute the competent Administrative Court of the Republic of Slovenia decides; on the second instance the Supreme Court of the Republic of Slovenia decides. The seat of the Administrative Court is in Ljubljana; however, it passes judgments also in its external departments: "Celje, Nova Gorica and Maribor". Party who exhausted all the legal remedies in its country can also lodge a legal remedy on the European Court of Human Rights. The condition to lodge a legal remedy on the ECHR is the indication of the party that by res judicata administrative act the right was violated, which was assured by the European Convention for the Protection of Human Rights and Fundamental Freedoms. In administration procedures, the violation of the Article 6 of the Convention, the right to trial within a reasonable time, is the most common. |
