Abstract

Trgovina z ljudmi je ena izmed oblik organiziranega kriminala in predstavlja hudo kršitev človekovih pravic. Zaradi njene pomembnosti se z njo ukvarja veliko število organizacij na mednarodni, regionalni in nacionalni ravni, poleg njih pa tudi številne nevladne organizacije. Slovenija je udeleženka trgovanja z ljudmi, in sicer kot izvorna, tranzitna in tudi ciljna država, kar pomeni, da ima tudi pri nas ta problem velike razsežnosti. V diplomski nalogi sem ugotavljala, kakšna je slovenska normativna ureditev boja proti trgovini z ljudmi in ali slovenska sodišča ustrezno obravnavajo problem trgovine z ljudmi. Ugotovljeno je bilo, da Slovenija na tem področju upošteva nacionalno zakonodajo in nekatere mednarodne dokumente. Najpomembnejši med njimi je Konvencija Sveta Evrope o ukrepanju proti trgovini z ljudmi. Zaradi uskladitve delovanja posameznih organov je bila v Sloveniji ustanovljena Medresorska delovna skupina, za koordiniranje njenega delovanja pa je imenovan nacionalni koordinator. Akcijski načrti delovne skupine so ustrezni, ampak je napredek prepočasen, ker se smernice in ukrepi slabo upoštevani. Slovenska ureditev sicer dobro zastavljena, vendar se v praksi ne izvaja dovolj uspešno. V Sloveniji je doslej prišlo do majhnega števila pravnomočnih sodb za ta kazniva dejanja in izrečene kazni so bile premile. Iz tega izhaja, da slovenska sodišča v boju proti trgovini z ljudmi niso dovolj uspešna.

Secondary abstract: Trafficking in human beings is one of the aspects of modern organised crime and it represents a severe violation of human rights. Due to the importance of the struggle against it, there are numerous organisations that help within their capacity, be it on the international, regional or on the national level, as well as some non-governmental organisations. Slovenia is a part of the international human trafficking, as a country of origin, transit and as a final destination of trafficked individuals, which means that it is a substantial national problem. In this bachelor's thesis we tried to examine the regulatory framework and the judiciary effectiveness of our fight against human trafficking. It was discovered, that Slovenia enforces national legislation as well as some international documents that pertain to the field. One of the most crucial international documents is the Council of Europe Convention on Action against Trafficking in Human Beings. For the purposes of coordination of the fight on the national level, Slovenia established the interdepartmental work group for the fight against human trafficking, which is overseen by a national coordinator. The group's action plans are satisfactory, but the progress is slow, due to poor implementation of it's guidelines and measures. The national framework is well-conceived, but progress must be made on it's implementation. Despite the magnitude of the problem, Slovenia only has a handful of final judgments for these types of crimes and the penalties aren't harsh enough. From these facts we can conclude, that the Slovene judicial system is ineffective in the battle agains trafficking in human beings.
