Abstract
Oglaševanje je tržno-komunikacijska dejavnost, namenjena povečanju prodaje. Je pravno urejeno kot samoregulativa pod okriljem Slovenskega oglaševalskega kodeksa v sklopu Slovenske oglaševalne zbornice, na državni ravni pa je zaobjeto v sklopu različnih zakonov. Evropska Unija daje smernice za poenotenje pogojev v različnih direktivah, a dopušča lastno zakonodajo. Podobno imajo Združene države Amerike oglaševanje pravno urejeno na različnih ravneh, vendar nad izvajanjem bdi večje število agencij. Nelojalno oglaševanje se pojavlja v različnih oblikah skozi različne kanale oglaševanja. V primeru kršitev je pristojen samoregulativni organ Oglaševalsko razsodišče Slovenske oglaševalske zbornice, upravne sankcije izvaja Tržni inšpektorat, civilnopravne in kazenske sankcije pa se dosegajo s postopki na sodiščih. Kazenske sankcije so določene v Kazenskem zakoniku.

Secondary abstract: |
Advertising is a market-communication activity designed to increase sales. It is legally regulated as a self-regulation under auspices of the Slovenian Advertising Code within the framework of the Slovenian Advertising Chamber, and it is part of the various laws at the state level. The European Union gives guidance on the unification of the conditions in the different directives but allows its own legislation. Similarly, the United States has legal advertising at various levels, but a greater number of agencies are overseeing implementation. Unfair advertising occours in various forms through various advertising channels. In the case of violations, the self-regulatory body is the Competent Authority of the Slovenian Advertising Chamber, administrative sanctions are achieved through court proceedings. Penal sanctions are defined in the Penal Code. |
