Abstract

Cilj diplomske naloge je proučiti in analizirati daytonski sporazum - mirovni sporazum, ki je prekinil vojno v BiH in je obenem postal ustava BiH. Prav tako je cilj raziskati pobude za spremembe ustave po vzoru zahodnoevropskih držav z namenom odpravljanja ovir pri približevanju BiH evropskim integracijam. Osrednje raziskovalno vprašanje diplomskega dela je, kateri so ključni elementi daytonskega sporazuma, zaradi katerih je ta država nefunkcionalna. Pri tem sem uporabil metodo analize primarnih virov, prav tako pa analizo in interpretacijo sekundarnih virov. Skozi analizo obstoječih dokumentov, ustave BiH ter primerov kompleksnosti in etnične determiniranosti bosansko-hercegovskega političnega sistema ugotavljam, da je napredek na različnih političnih področjih vendarle viden, zlasti na področju odprave diskriminatornih državnih in entitetnih ustavnih določil, potrebnega pa bo še veliko dela, da se bo ta država politično odmaknila od obstoječe etnokracije in dosegla standarde EU na področju spoštovanja človekovih pravic.

Secondary abstract: Aim of diploma is to study and analyse Dayton agreement, which is peace agreement, that end the war in Bosnia-Herzegovina and at the same time presents constitution of Bosnia-Herzegovina. Aim is also to research initiatives for constitutional changes in zeitgeist of the time and to remove obstacles for Bosnia getting closer to European integrations. Main research question of this diploma is what are the key elements of Dayton agreement, that produce non-functional state. I used primary sources method, as well as analysis and interpretation of secondary sources. Through the analysis of existing documents, Bosnian constitution and cases of complexity and ethnical determination of political system of Bosnia-Herzegovina I conclude that there has been made some progress in different political areas, especially on elimination of discriminatory state and entity provisions, but it is needed a lot of work to be done in Bosnia-Herzegovina to move from existing ethnocracy and achieve EU standards regarding respect of human rights.
