Odpoved delovnega razmerja v primeru stečaja in pravice delavcev

Abstract

V diplomskem projektu predstavimo pomen pojmov stečaj podjetja in stečajni postopek ter organe v stečajnem postopku. Stečajni postopek ali stečaj je oblika prenehanja dolžnika, ki je prezadolžen ali plačilno nesposoben, dolžnikovo premoženje pa ne zadošča za kritje vseh njegovih obveznosti. Namen stečaja je, da so vsi upniki obravnavani enako in da dobijo poplačan enak delež svojih prijavljenih in priznanih terjatev. Po končanem stečaju podjetje preneha s poslovanjem, saj se izbriše iz sodnega registra. Da se stečajni postopek uspešno izvede, so potrebni organi stečajnega postopka. Ti organi so stečajni senat, stečajni upravitelj in upniški odbor. Predstavimo tudi pravice delavcev in vlogo jamstvenega sklada. Delovanje slednjega je namenjeno delavcem, ki so dobili odpoved delovnega razmerja zaradi insolventnosti njihovega delodajalca.

Secondary abstract:	The graduation thesis project presents the meaning of the concepts of bankruptcy, the bankruptcy process and the authorities in bankruptcy proceedings. Bankruptcy proceedings or bankruptcy is a form of termination of the debtor who is overindebted or insolvent and their assets do not suffice to cover all their financial obligations. The purpose of bankruptcy is that all creditors are treated equally and are reimbursed an equal share of their registered and recognised debt. After bankruptcy is completed, the company ceases its operations because it is erased from the court register. Authorities of the bankruptcy proceedings are needed for successful bankruptcy proceedings. These are the bankruptcy senate, the bankruptcy manager and the creditor committee. The thesis also presents the rights of workers and the role of the guarantee fund. The operation of the latter is intended for workers who received a dismissal of an employment relationship because of bankruptcy of their employer.
