Abstract

Zapuščenim živalim se mora zagotoviti pomoč, oskrba in namestitev v zavetišču, zavetišče pa je lokalna zadeva javnega pomena, ki se izvaja, kot gospodarska javna služba. Če je neka dejavnost potrebna za normalno delovanje družbe in je zato ni mogoče prepustiti zasebnemu sektorju v upravljanje, se jo podredi javnopravnemu režimu javne službe, ki je v organizaciji države ali lokalne skupnosti. Javne službe delimo na negospodarske in gospodarske, slednje se lahko zagotavlja v različnih oblikah: režijski obrat, javni gospodarski zavod, javno podjetje, s podeljevanje koncesij. Koncesija je neke vrste pooblastilo, ki ga po predpisanem postopku in obliki, podeli država ali lokalna skupnost osebi civilnega prava, torej opravljanje neke dejavnosti se prenese v zasebno sfero, ampak ostaja pod nadzorstvom javne oblasti. Koncesija je tudi najbolj pogosta oblika izvajanja gospodarske javne službe pomoči, oskrbe in namestitve zapuščenih živali v zavetišču, ki se je poslužujejo Slovenske občine. Zakon o gospodarskih javnih službah točno določa po kakšnem postopku morajo izbrati koncesionarja. Prvo sprejmejo odlok o načinu opravljanja gospodarske javne službe, sledi koncesijski akt na podlagi katerega se objavi javni razpis, nato se o izbiri koncesionarja odloči z upravno odločbo ter z njim sklene koncesijsko pogodbo. Občina Škofja Loka v tem delu ni spoštovala zakonodaje, kljub temu da ima sklenjeni pogodbi z dvema zavetiščema za oskrbo mačk in psov na njenem območju, pa za to ni sprejela ustrezne pravne podlage in opravila izbire izvajalca na podlagi javnega razpisa. Seveda pa ni osamljen primer, velik odstotek občin po Sloveniji skrbi za zapuščene živali, nima urejene v skladu z zakonodajo. S tem, ko niso sprejele ustrezne pravne podlage in objavile javnega razpisa, kršijo načelo ustavnosti in zakonitosti ter prepovedi diskriminacije - zagotovitev enakih možnosti za vse potencialne prijavitelje, ki izpolnjujejo predpisane pogoje za zavetišča za zapuščene živali.

Secondary title: Caring for abandoned animals in municipalities
Secondary abstract: Abandoned animals shall be offered help, care and housing in animal shelters; an animal shelter is a local matter of public importance that is carried out as public services. If an activity is necessary for a normal functioning of society and therefore cannot be left to manage by the private sector, it is subject to a public-law public service regime that is organised by either the state or the local community. Public services are divided into non-economic and economic ones; the latter can be provided in various forms: a public company, or by granting concession, ... A concession is some kind of an authorisation, which, based on a prescribed procedure and form, is granted by the state or a local community to a person of civil law. Thus, the performance of an activity is transferred to the private sphere but remains under the control of the public authority. The concession is a form of the public services to provide help, care and housing of abandoned animals in a shelter; it is the most common form used by the Slovenian municipalities. The Services of General Economic Interest Act specifies the procedure to select a concessionaire. First, the decree on the manner of performing public services is adopted. This is followed by the concession act based on which a public tender is issued. The choice of the concessionaire is decided with an administrative decision, and the concession contract is concluded with the concessionaire. The municipality of Škofja Loka has not respected the legislation in this part even though it concluded a contract with two animal shelters for cats and dogs in the area. It has not adopted the appropriate legal basis for it and it has not selected the provider based on a public tender. This municipality, of course, is not an isolated case; a large percentage of municipalities in Slovenia that take care of abandoned animals have not adopted the appropriate legal basis in accordance with the legislation. By failing to adopt the appropriate legal basis and to issue a public tender, the municipalities violate the rule against discrimination – ensuring equal opportunities for every potential applicant who meets the prescribed conditions for shelters for abandoned animals.
