Abstract

Družinsko pravo kot del civilnega prava je zaradi svoje vsebine za razliko od drugih področjih prava zelo specifično pravno področje. Zakonsko je urejeno z Zakonom o zakonski zvezi in družinskih razmerjih, s tem zakonom pa se v skladu s 1. členom urejajo zakonska zveza, razmerje med starši in otroki in med drugimi sorodniki, posvojitev, rejništvo ter varstvo mladoletnih otrok in drugih oseb, ki niso sposobne same skrbeti zase, za svoje pravice in koristi. V sodne družinske postopke so poleg polnoletnih oseb, vključene tudi mladoletne osebe oziroma otroci. Sodišče je v skladu z načelom največje otrokove koristi primorano vedno zasledovati koristi otroka, ko odloča o trenutnih in nadaljnjih razmerah v družini. Otroci po Ustavi Republike Slovenije v skladu s 56. členom uživajo posebno varstvo in skrb.

Secondary title: The role and importance of a court expert in a family lawsuit
Secondary abstract: Family law, as part of civil law, is a very specific legal field, unlike other areas of law, due to its content. It is legally regulated by the Marriage and Family Relations Act. In accordance with Article 1, this law regulates marriage, the relationship between parents and children and among other relatives, adoption, foster care and the protection of minors and other persons who are not able to take care of themselves, for their rights and benefits. In addition to adult persons, family court proceedings include minors or children. In accordance with the principle of the greatest child's benefit, the Court is always obliged to pursue the child's benefits when deciding on the current and further conditions in the family. In accordance with Article 56 of the Constitution of the Republic of Slovenia, children enjoy special protection and care.
