Abstract

Stavbna pravica je stvarna pravica, ki se je v slovenskem pravnem redu pojavila leta 2003 z uvedbo Stvarnopravnega zakonika(SPZ). Po vsebini bi jo lahko primerjali z služnostjo, vendar je stavbna pravica svojevrstna stvarna pravica s povsem drugačnimi lastnostmi, kar izhaja že iz njene zakonske definicije. Gre namreč za stvarno pravico, ki omogoča ločeno lastništvo na zgradbi, brez hkratnega lastništva na zemljišču, na katerem je zgradba zgrajena. Stavbna pravica načeloma nastane na podlagi pravnega posla. Na podlagi pravnega posla lahko tudi preneha, poleg tega pa so možni tudi drugi načini prenehanja stavbne pravice, med katerimi je najpogostejši način najverjetneje prenehanje zaradi preteka časa, za katerega je bila ustanovljena. Stavbna pravica je stvarna pravica, ki se vpisuje v zemljiško knjigo, zaradi česar je potrebna usklajenost stvarnopravnih določb, ki urejajo stavbno pravico, tudi z določbami Zakona o zemljiški knjigi(ZZK-1). V svoji diplomski nalogi bom podrobneje predstavila pravno ureditev stavbne pravice v slovenskem pravnem redu. Najprej bom povzela njene temeljne lastnosti, nato pa bom na podlagi zakonske ureditve predstavila nastanek stavbne pravice, razmerje med lastnikom nepremičnine in imetnikom stavbne pravice in možne načine njenega prenehanja. Pri pisanju si bom pomagala tudi s pravno literaturo in s sodno prakso slovenskih sodišč. Na podlagi vsega bom na koncu poskušala predstaviti prednosti, ki jih prinaša ustanovitev stavbne pravice v primerjavi z ostalimi stvarnimi pravicami.

Secondary title: Legal regulation of building right in slovenian law
Secondary abstract: Building right is a material right which was introduced into Slovenian legislation in the year of 2003 with the implementation of Law of Property Code (»LPC«). By its content it can be compared to servitudes, however the building right is a unique material right with completely different properties as follows already from its legal definition. As it is seen from definition, building right allows property right on building without property right on land at the same time. Building right is in principle created by contract. By contract it can be also terminated, however there are also other different ways of its cancellation among which the most common is termination because the time has expired. Building right is the material right which has to be entered into Land Registry. This requires the consistency of legal regulation of building right also with the Land Registry act. In my diploma I will present legal regulation of building right in Slovenian law. First I will describe its main properties. Furthermore I will present the creation of building right, relationship between the owner of property and the holder of building right and possible ways of its termination. When writing I will also use legal literature and Slovenian practice. At the end of my diploma I will also try to present main qualities of creating building right in comparison with creation of other material rights.
