Abstract

Garancija za brezhibno delovanje je pravni institut, ki predstavlja skupek pravnih pravil, ki urejajo obveznosti proizvajalca in prodajalca, da bo stvar v določenem roku brezhibno delovala. V slovenskem pravnem redu glede na pravni temelj nastanka obveznosti ločimo dve vrsti garancije: obvezna garancija in prostovoljna garancija. Po vsebini sta popolnoma enaki, ločita se po pravnem temelju. Prva, obvezna (zakonska) garancija nastane na podlagi zakona, medtem ko druga, prostovoljna (pogodbena) garancija nastane z enostranskim pravnim poslom, in sicer z izdajo garancijskega lista. Osrednja tema diplomske naloge so predvsem problemi, s katerimi se kupec srečuje pri uveljavljanju garancije, kot so na primer neizdan ali pomanjkljivo izdan garancijski list ter uveljavljanje garancije kakor tudi uveljavljanje garancije brez računa.

Secondary title: Enforcement of guarranty without receipt or warranty certificate
Secondary abstract: Guarantee is a legal concept regulated by a set of legal rules that determine obligations of a manufacturer and a seller in regard to flawless operation of goods within the guarantee period and counter rights of a customer. Depending on the legal basis of obligation, two types of guarantee are distinguished in Slovenian legislation: voluntary and obligatory guarantee. Both have the same in content, but they differ in the legal basis. The former, obligatory (legal) guarantee is created on the basis of law while the later, voluntary (contractual) guarantee is formed with unilateral legal transaction, by issuing a warranty certificate. The main topic of the thesis are presented various problems of consumers regarding guarantees, such as the unissued or inadequately issued warranty card, enforcement of a guarantee and enforcement of a guarantee without a bill.
