Abstract
Magistrsko delo Tajnost pri opravljanju zdravstvenih storitev temelji na izhodišču, da je zaupanje bistveni del razmerja med zdravnikom in bolnikom. Bolniki se lahko zaradi pomanjkanja zaupanja začnejo izogibati zdravljenju ali zdravniku zaupajo premalo potrebnih informacij za uspešno zdravljenje. Dolžnost varovati poklicno skrivnost, ki je opredeljena v Zakonu o pacientovih pravicah, je tesno povezana s poklicno etiko. Za poklicno skrivnost se šteje informacija, ki jo zdravnik pridobi med opravljanjem svojega poklica. Načela medicinskega kodeksa zdravnika ne vežejo, če za skrivnost izve zasebno ali po naključju. Sodoben zdravstveni sistem brez zbirke velikega števila medicinskih podatkov v računalniških sistemih ne bi mogel delovati, saj prav te pospešujejo delovanje učinkovitega zdravstvenega sistema. Za zbiranje medicinskih podatkov je potrebna dosledna uporaba varnostnih ukrepov, kar mora izhajati iz nacionalne zakonodaje (Zakona o varstvu osebnih podatkov in Zakona o pacientovih pravicah) in zakonodaje Evropske unije. Maja 2016 je Evropska unija sprejela novo Splošno uredbo 2016/679 o varovanju osebnih podatkov (z angleško kratico GDPR), ki je stopila v veljavo 25. 5. 2018. Uredba zagotavlja pacientom več pravic, predvsem da so bolje obveščeni o uporabi njihovih osebnih podatkov, na drugi strani pa nalaga več odgovornosti subjektom, ki upravljajo osebne podatke. Nacionalni informacijski sistem eZdravje omogoča veliko pozitivnih rešitev za učinkovito obdelavo pacientovih podatkov, vendar je treba opozoriti na možnost zlorab znotraj sistema. V magistrskem delu bodo analizirani bistveni elementi podanih iztočnic in zaključne ugotovitve glede na opravljeno raziskavo predmetne tematike.

The Master's thesis Confidentiality in the Provision of Healthcare Services is based on the premise that trust is the main component of the relationship between a doctor and a patient. Due to a lack of trust patients may avoid seeking medical treatment or may not give doctors sufficient information for a successful treatment. The obligation of professional secrecy, which is defined by the Patient Rights Act, is closely linked to professional ethics. Information obtained by doctors while exercising their profession is covered by the obligation of professional secrecy. The principles of the medical code of ethics do not apply if doctors obtain the information outside their professional setting or by coincidence. Without a computer-based database containing a large number of medical data modern healthcare systems could not function as the databases facilitate the functioning of efficient healthcare systems. The collection of medical data has to include a consistent implementation of safety measures imposed by national legislation (the Personal Data Protection Act and the Patient Rights Act) and EU legislation. In May 2016 the European Union adopted the new The General Data Protection Regulation 2016/679 (GDPR) which entered into force on 25 May 2018. The regulation ensures patients more rights, particularly the right to be better informed about the use of their personal data, but on the other hand it imposes more responsibilities on the entities that manage personal data. The national information system eZdravje (eHealth) brought many positive solutions for an efficient processing of patients' data, however, it is necessary to point out at the possibility of data misuse within the system. The Master's thesis analyses the key elements of the aforementioned premises and the conclusions based on a research we conducted the topic. |
