Abstract
Pariški dogovor o omejevanju izpustov v zrak spada v normativni okvir mednarodnega okoljskega prava. V namen prikaza njegove geneze diplomsko delo začrta pregled mednarodnega okoljskega prava s sprejetjem Stockholmske deklaracije. Vseskozi se geneza Pariškega dogovora o omejevanju izpustov v zrak kaže v postopnem spodbujanju in oblikovanju kolektivne mednarodne odgovornosti blaženja in upravljanja posledic škodljivih emisijskih plinov, ki povzročajo globalno segrevanje. V namen prikaza tovrstnega razvoja se delo nadaljuje s predstavitvijo Deklaracije iz Ria in Okvirne konvencije Združenih narodov o okoljskih spremembah (UNFCCC). Znotraj te se na 3. srečanju strank sprejme danes neuspešni Kjotski protokol. Kasneje,leta 2015, na 21. srečanju strank pa tudi sam Pariški dogovor, ki je tako neizogibno povezan z več desetletnim stopnjevanjem mednarodnih zavez varstva okolja. Skozi linearni razvoj predhodno sprejetih dokumentov formalnega mednarodnega prava diplomsko delo prikazuje, da je uspešnost Pariškega dogovora v veliki meri odraz dolgotrajnega in konsistentnega stopnjevanja obveznosti držav članic UNFCCC. Te so s Pariškim dogovorom presegle diferenciacijo izključne odgovornosti razvitih držav ter tako končno izoblikovale univerzalno mednarodno iniciativo jasnejših obveznosti, ki veljajo tudi za države v razvoju. Pariški dogovor o omejevanju izpustov v zrak se navezuje na pravno zavezujočo obvezo držav, da bodo z zaporednimi nacionalno določenimi obveznostmi ohranjale globalno temperaturo pod 2 °C glede na predinstustrijsko dobo leta 1990. Mehanizmi Pariškega dogovora so utemeljeni predvsem na transparentnosti in samoiniciativnosti zadajanja ciljev znotraj nacionalno določenih obveznosti.V prikaz vprašanja pomanjkljivosti diplomsko delo obravnava tudi posamezne načrte implementacije doseganja ciljev Dogovora. S Pariškim pravilnikom, ki je trenutno še vedno v izdelavi, pa ostaja sama učinkovitost Dogovora še vedno odprte narave in predvsem v rokah posameznih držav pogodbenic.

The Paris Agreement on Emission Reduction falls within the normative framework of international environmental law. For the purpose of demonstrating its genesis, the diploma thesis outlines the review of international environmental law with the adoption of the Stockholm Declaration. Throughout the genesis of the Paris Agreement on Emission Reduction the thesis reflects itself in the gradual promotion and creation of collective international responsibility for mitigating and managing the consequences of harmful emissions that cause global warming. Display of this development continioues with representation of the Rio Declaration and the United Nations Framework Convention on Environmental Change (UNFCCC). At the 3rd Party Meeting of UNFCCC the today unsuccessful Kyoto Protocol was adopted. Later in 2015, at the 21st Meeting of the Parties, the Paris Agreement itself is adopted, which is inevitably linked to the decades-long intensification of international environmental protection commitments. Through the linear development of previously adopted documents of formal international law, the diploma thesis shows that the effectiveness of the Paris Agreement largely reflects on the long and consistent escalation of the obligations within the UNFCCC Member States. With the Paris Agreement, Member states surpassed the differentiation of the exclusive responsibility of the developed countries, and finally formed a universal international initiative of clearer obligations, which now also apply to developing countries. The Paris Agreement relates to a legally binding commitment by States to maintain a global temperature below 2°C in accordance with the pre-industrial period in 1990. The mechanisms of the Paris Agreement are based primarily on the transparency and self-initiative of setting goals within the national determent obligations. To show the issue of shortcomings, the diploma thesis also deals with individual plans for implementation of the achived objectives of the Agreement. With the Paris Regulations, which are still under construction, the effectiveness of the Treaty remains open and, above all, in the hands of individual State Parties. |
