Abstract

Razvoj letalstva se je začel s prvim poletom na začetku prejšnjega stoletja, potreba po mednarodnopravni ureditvi zračnega prostora pa je prišla šele nekaj let kasneje, s I. svetovno vojno, ki je razkrila, kakšno nevarnost lahko za države predstavljajo letala, uporabljena v vojaške namene. Prav ta potreba po varnosti je vodila do niza mednarodnih aktov, ki so urejali in še danes urejajo zračni prostor na mednarodni ravni.Mednarodni zračni prostor je razdeljen na različne mednarodnopravne režime, ki se med seboj razlikujejo po tem, kakšno stopnjo suverenosti imajo države v njih. Od zračnega prostora nad državnim ozemljem s teritorialnim morjem, kjer ima država popolno in izključno suverenost, pa do zračnega prostora nad odprtim morjem, kjer nobena nima jurisdikcije in gre za skupno dediščino človeštva, ki pripada vsem državam, ne glede na njihovo geografsko lego.Mednarodna organizacija civilnega letalstva je organ pod okriljem Organizacije združenih narodov, ki temeljni na suverenosti držav članic in spodbuja razvoj mednarodnega letalskega prevoza na varen in miren način. Njen ustanovitveni akt, Čikaška konvencija, je ena izmed najbolj množično podpisanih mednarodnih pogodb in je primarni pravni vir mednarodnega letalskega prava.

Secondary abstract: The development of aviation started with the first flight at the beginning of the last century, and the necessity of international airspace legislation came a few years later, with the World War I, that revealed what kind of danger the airplanes used for the war purposes could represent for the countries. It was exactly the need for security that lead to a number of international laws that used to regulate and are regulating today the airspace on international scale.The international airspace has been divided according to different international legal regimes that differ from each other regarding the level of sovereignty the countries have over the airspace. The legal regimes range from the airspace over the territory of a country having its territorial sea, where the country has total and exclusive sovereignty, to the airspace over the open sea, where no country has jurisdiction and which accounts for common heritage of humanity, belonging to all countries, irrespective of their geographical position. International Civil Aviation Organization is a specialized agency of the United Nations, which is based on the sovereignty of the member countries and which encourages the development of the international civil aviation and its safety. Its founding act, the Convention on International Civil Aviation, also known as Chicago Convention, is one of the most widely signed international conventions and it represents a primary source of international aviation legislation.
