Abstract
Magistrsko diplomsko delo se začenja s teoretičnim pogledom na pojav prava in legitimnost zakonodajne oblasti ter predstavitvijo faz zakonodajnega procesa. V drugem delu se nadaljuje z opisom stika pravne in politične kulture ter položaja, ki ga zasedajo pri tem politične stranke. Med drugim sta predstavljeni tudi notranja delitev političnih strank na tri dele ter zunanja razmejitev med koalicijske in opozicijske stranke.
Tretji del vsebuje preučitev delovanja subjektov, ki imajo pristojnost zakonodajne pobude, v času pred formalno vložitvijo predloga v parlament. Predstavljeni so podatki, ki kažejo na veliko moč vlade ter posledično vladnih političnih strank v tej fazi. Zaradi tega je v tem delu podrobneje razdelan tudi postopek priprave vladnega predloga zakona v sferi državne uprave. Nekaj pozornosti ta del nameni tudi preučitvi politične neodvisnosti javnih uslužbencev.
Četrti del se posveti zakonodajnemu dogajanju v parlamentu. Pri tem je pomemben položaj poslanske skupine, ki politične stranke zastopa v državnem zboru. Predstavljena je analiza, ki ugotavlja visoko enotnost glasovanja poslancev znotraj poslanskih skupin ter tudi znotraj koalicije.
V zadnjem delu je podrobneje predstavljen referendum, s katerim lahko volivci preprečijo uveljavitev zakona. Kljub temu, da lahko referendum zahtevajo zgolj državljani in da se pristojnost zakonodajnega odločanja pri tem od poslancev prenese na vse volivce, se stranke tudi v tej fazi trudijo vplivati na izid.

The role of political parties in the legislative process |
Secondary abstract: |
Master's thesis begins with the theoretical reflection on the concept of law and legitimacy of the legislative power, followed by the description of legislative process and its stages. The second part deals with the connection between legal and political culture and with the role that political parties play in this. It describes internal tripartite organisation of political parties and external division into coalition and opposition parties.
The third part explores activities of the subjects with the right to propose a bill, focusing on the phase before formally submitting it to the parliament. The data shows considerable power of the government at this stage of the legislative process and thus also of the governing political parties. Therefore, this part of the thesis delves into the process of drafting a bill in the state administration that leads to a governmental legislative proposal. This part includes a brief reflection on the political independence of public servants.
The fourth part focuses on the legislative procedures in the parliament. Here, a position of a parliamentary group is very important as they represent political parties in the parliament. An analysis reveals a high unanimity in voting within parliamentary groups and coalitions.
The last part focuses on a referendum that enables citizens to repeal legislation. Citizens only can demand a referendum, thus transferring the legislative powers from the political parties to the voters; however, the political parties still try to influence the outcome. |
