Abstract

V magistrskem delu obravnavam in analiziram pravno ureditev postopkov oploditve z biomedicinsko pomočjo (OBMP) v Republiki Sloveniji. Analiziram Zakon o zdravljenju neplodnosti in postopkih oploditve z biomedicinsko pomočjo (ZZNPOB), sprejet leta 2000, in ga primerjam z nekaterimi sorodnimi zakoni v tujini. Uvodoma predstavim razvoj postopkov oploditve z biomedicinsko pomočjo in podam kratek zgodovinski pregled pravnih ureditev. Nato kratko izpostavim glavna moralno-etična vprašanja, s katerimi se danes spopada reproduktivna medicina. V osrednjem delu naloge obravnavam nekatera pomembnejša vprašanja, kot so vprašanja upravičencev postopkov OBMP, starostne omejitve, darovanje spolnih celic in zarodkov, nadomestno materinstvo in posthumne postopke. V okviru primerjalno pravne predstavitve poskušam najti podobnosti in razlike z domačo zakonodajo. S pomočjo predstavitve sodne prakse izpostavim problematiko, ki se je pojavila zaradi različnih pravnih ureditev v državah članicah Evropske unije in zaradi prostega pretoka storitev. V nadaljevanju obravnavam institut posthumne OBMP, nadomestnega materinstva in postopke darovanja spolnih celic. Zadnje poglavje namenim organizacijski ureditvi postopkov OBMP, kjer opozorim na potrebno posodobitev tako zakonske, kot podzakonske ureditve.

Secondary abstract: This Master’s Thesis demonstrates and analyses legal regulation of biomedical assisted procreation procedures (BMAPPSs) in the Republic of Slovenia. I analyze the Infertility treatment and procedures of biomedically-assisted procreation act (ZZNPOB), adopted in 2000 and compares it with some similar foreign acts. Firstly I present the evolution of biomedical aid treatment procedures and shortly submits history of legal regulations. I briefly outlines the main moral-ethical issues faced by the reproductive medicine. The central part of the Master’s Thesis, analyzes some of the most important institutions such as beneficiaries of procedures, age limit, donor procedures, surrogate motherhood and post-mortem examination I compare legal similarities and differences between different legal regulations. Through the presentation of the case-law she highlights the issues arising because of the different legal regulations of within the European Union Member States and the because free movement of services. Following chapters analyze gamete donation procedures, surrogacy and post-mortem fertilization, while the last chapter explains the organizational arrangements for BMAPP procedures and draw attention to the necessary modernization of legal act and executive acts.
