Abstract

Magistrsko delo v štirih vsebinskih sklopih obravnava pravico do izobraževanja kot eno izmed temeljnih človekovih pravic in svoboščin. V prvem sklopu magistrskega dela sem predstavila pravico do izobraževanja kot človekovo pravico ter na kratko orisala njen zgodovinski razvoj. Pri predstavitvi aktualnega razvoja pravice do izobraževanja sem s pomočjo statističnih podatkov ugotavljala dejansko stanje sistemov izobraževanja ter raven izobraženosti ljudi v Sloveniji in po svetu. Drugi sklop magistrskega dela je namenjen analizi pravice do izobraževanja skozi mednarodnopravne dokumente, v katerih je pravica vsebovana.Pravica do izobraževanja je bila formalno priznana kot človekova pravica s sprejetjem Splošne deklaracije o človekovih pravicah, od takrat pa je bila vključena v številne mednarodne konvencije oz. pakte, pri čemer pomembno vlogo igrata OZN in UNESCO. Tretji sklop magistrskega dela vključuje analizo pravice do izobraževanja v Sloveniji, kjer sta predstavljena razvoj pravice do izobraževanja skozi pretekle ustave ter njena sedanja ustavna in zakonska ureditev. Zadnji vsebinski sklop magistrskega dela je namenjen predstavitvi in analizi primerov kršitve pravice do izobraževanja v okviru precedenčne sodne prakse Evropskega sodišča za človekove pravice, Sodišča Evropske unije in Ustavnega sodišča Republike Slovenije ter izbranih primerov tuje ustavnosodne prakse.

Secondary abstract: This Master's thesis deals with the right to education as one of the fundamental human rights and freedoms in four content sets. The first set presents the right to education as a human right together with its briefly outlined historical development. In order to present the current development of the right to education statistics were used to establish facts about the educational systems and the level of people's education in Slovenia as well as around the world. The subject of the second set is an analysis of the right to education according to international legal documents, in which this right is enshrined. The right to education has been formally recognized as a human right by the adoption of the Universal Declaration of Human Rights and has since then been included in a number of international conventions and pacts, whereby the UN and UNESCO played an important role. The third set of master's thesis incorporates an analysis of the right to education in Slovenia, where the development of the right to education through the historic constitutions and its current constitutional and statutory regulation are presented. The last set of the master's thesis is intended to present and analyse cases of violation of the right to education in the framework of relevant case law of the European Court of Human Rights, European Court of Justice, the Constitutional Court of the Republic of Slovenia andselected cases of foreign constitutionalcase law.
