Abstract
Diplomsko delo z naslovom Policijski postopki z mladoletniki je predstavitev bistvenih
izhodišč na področju obravnavanja mladoletnih prestopnikov s strani policije v Republiki
Sloveniji. Osrednji namen diplomske naloge je bil preučiti pojav in oblike mladoletnega
prestopništva, opredeliti njegove značilnosti v Republiki Sloveniji ter preučiti naloge in
pooblastila slovenskih policistov pri obravnavi mladoletnih prestopnikov. Natančneje, želeli
smo ugotoviti ali so pri obravnavi mladoletnikov z zakoni določene posebnosti, ki jih morajo
policisti v postopku z mladoletnimi prestopniki upoštevati. Mladoletni prestopnik je
posameznik, ki s svojim odklonskim vedenjem, ki je zavestno in voljno, krši družbena pravila
in norme. Za opredelitev obsega pojava, oblik pojavljanja in posledic nasilja največkrat
uporabljamo podatke, ki jih beleži policija. Število kaznivih dejanj, za katera so kot storilci v
policijski statistiki zabeleženi mladoletniki, niha med 2000 in 5000, te številke pa so le del
realnosti, kajti le del storjenih kaznivih dejanj policisti dejansko odkrijejo. Policisti
mladoletne prestopnike obravnavajo v v policijskih postopkih, v skladu s svojimi pooblastili,
ki so z zakonom določeni ukrepi, ki omogočajo opravljanje policijskih nalog in s katerimi se
praviloma posega v človekove pravice ali temeljne svoboščine ali druge pravice
posameznika. Ugotovitve analize policijskih postopkov proti mladoletnikom kažejo, da
število obravnav mladoletnih storilcev kaznivih dejanj z leti upada. Prav tako smo ugotovili,
da obstajajo posebnosti pri pooblastilih policistov v policijskem postopku proti otrokom in
mladoletnikom in sicer na področju vabljenja otrok in mladoletnikov, privedbe otroka ali
mladoletnika, pridržanja mladoletnika ter uporabe prisilnih sredstev. Policisti smejo vabiti
otroka ali mladoletnika le preko staršev ali skrbnikov oziroma zakonitih zastopnikov. O
morebitni privedbi in pridržanju otroka ali mladoletnika morajo policisti obvestiti
mladoletnikove starše oziroma skrbnike, medtem ko prisilnih sredstev proti otrokom policist
načeloma ne sme uporabiti.

The diploma paper titled Police procedures with minors is a presentation of the essential starting points in the field of treatment of juvenile offenders by the police in the Republic of Slovenia. The main purpose of the diploma thesis was to examine the phenomenon and forms of juvenile delinquency, to define its characteristics in the Republic of Slovenia and to examine the tasks and powers of Slovenian police officers in dealing with juvenile offenders. More specifically, we wanted to find out whether the specifics of juvenile delinquency in the treatment of minors have to be taken into account by the police in the procedure for juvenile offenders. A juvenile offender is an individual who, with his deviant behavior, consciously and willingly violates social rules and norms. In order to define the extent of the phenomenon, forms of occurrence and the consequences of violence, we mostly use the data recorded by the police. The number of crimes for which juveniles are recorded as perpetrators in police statistics varies between 2000 and 5000, and these numbers are only part of the reality, because only a part of the crimes are actually discovered by police officers. Police officers deal with juvenile delinquents in police procedures in accordance with their powers, which are legally defined measures that enable police tasks to be carried out and which generally interfere with human rights or fundamental freedoms or other rights of an individual. The findings of the analysis of police procedures against minors show that the number of cases of juvenile perpetrators of criminal offenses has declined over the years. We also found that there are specialties in the powers of police officers in the police procedure against children and minors in the field of inviting children and minors, bringing a child or a minor, detaining a minor and using coercive means. Police officers may invite a child or minor only through their parents or guardians or legal representatives. The police officers should inform the minor's parents or guardians about the possible apprehension and detention of a child or minor, while the police officer should not use coercive measures against children. |
