Abstract

Nasilje in religija sta v zahodni družbi vse bolj prisotna. Širjenje konfliktov je povezano s tremi velikimi monoteističnimi religijami: krščanstvom, islamom in judaizmom. Uveljavljanje religije spremlja nasilje, prepričanje o ogroženosti, potreba po stopnjevanju sovraštva. Države, predvsem na zahodu, poskušajo to rešiti z dialogom, da zagotovijo strpno življenje različnim kulturam in civilizacijam. Bistvo zahodne civilizacije je predvsem svoboda. V Afriki in Aziji pa je zgodba popolnoma drugačna, saj je tam nasilje prisotno vsakodnevno. V muslimanskem svetu je moč zaznati dvig pomena islama, ki se kaže v treh elementih: naraščanju osebne religioznosti, intenzivnem vstopanju islama v javno življenje in krepitev političnega islama. Magistrska naloga obravnava problematiko verske svobode, ki je temeljna človekova pravica. Osrednja tema je versko prepričanje v ustavnih ureditvah in njeno uresničevanje. Države imajo v svoji ustavi opredeljeno pravico do verske svobode, vendar je v praksi ta pravica velikokrat omejena ali kršena. V magistrski nalogi so predstavljeni številni mednarodni in evropski akti, ki opredeljujejo, urejajo in spoštujejo pravico do verske svobode. Obravnavani so številni primeri, kako države versko svobodo dejansko uresničujejo, zagotavljajo in jo varujejo v praksi. V nalogi ugotavljam, da je verska svoboda vedno bolj prisotna v javnem življenju, jo pa slabo sprejemajo države. Cilj magistrske naloge je predvsem ugotoviti, ali je pravica do svobode veroizivedi zagotovljena v vseh državah enako in ali je poskrbljeno za njeno dejansko uresničevanje in varnost.

Secondary abstract: Violence and religion are increasingly present in western society. The dispersal of conflicts is linked between three major monotheistic religions: Christianity, Islam and Judism. The practice of religion is accompanied by violence, a belief in the threat, the need to intensify hatred. Countries, especially in the West, are trying to solve this problem through dialogue, in order to ensure tolerant life for different cultures and civilizations. The essence of western civilization is above all freedom. In Africa and Asia, however, the story is completely different; on these continents violence is present everyday. In the Muslim world, it is possible to perceive the rise of the relevance of Islam, which is manifested in three elements: the rise of personal religiousness, the intense entry of Islam into the public domain, and the strengthening of political Islam. This master's thesis deals with the problem of religious freedom, which is a fundamental human right. The central theme is religious belief in constitutional arrangements and its implementation. States provide the right to religious freedom in their constitutions, but this right is often restricted or violated in practice. In the following, I presented a number of international and European acts that define and respect the right to religious freedom. A number of examples on how different countries actually implement, guarantee and protect religious freedom in practice ispresented in this research. As it is shown, religious freedom is increasingly present in the public life, which, however, is poorly accepted by the states. The main objective of this master's thesis was to determine whether the right is guaranteed in all countries in the same way and whether its implementation and safety are actually ensured.
