Abstract

Varstvo potrošnikov je relativno mlada pravna panoga. Razvijati se je začela v 20. stoletju in prvič pogovoru ameriškega predsednika Kennedyja dobila svoje mesto med temeljnimi človekovimi pravicami. Varstvo potrošnikov je bilo postavljeno na stranski tir s pogodbo o Evropski gospodarski skupnosti. Resneje se je na Evropskih tleh začelo razvijati po letu 1985.Z Maastrichtsko pogodbo beležimo nastanek Evropske unije. Ko je prevzela pogodbe Evropske skupnosti, je s tem v svoje temeljne določbe prevzela člen, ki prispeva h krepitvi varstva potrošnikov. Od tu naprej se je varstvo potrošnikov izboljšalo in napredovalo skupaj s krepitvijo notranjega trga. Tekom sprejemanja sekundarnih pravnih virov, je Komisija naletela na problem harmonizacije pravnih virov. Zaradi neusklajenosti zakonodaje med državami članicami si vedno bolj prizadeva h popolni harmonizaciji. Na področju varstva potrošnikov je bilo sprejetih veliko direktiv, ki urejajo to pravno panogo. Pobudo za reševanje in varovanje zlorab so prevzeli tudi potrošniki sami in začeli ustanavljati potrošniške organizacije, ki so neodvisne in nevladne.

Secondary abstract: Consumer protection is relatively young branch of legal department. It began to develop in the 20th century. After a speech was given by the American president Kennedy it got a place amongst fundamental human rights. Consumer protection has been sidelined with an agreement on the European Economic Community. On the European floor more serious development began after the year 1985. The Treaty of Maastricht records the formation of the European Union. When it took over the contracts of the European Communities transferred its core provisions: the objective to contribute the strengthening of the consumer's protection. From here on, the consumer protection has improved and progressed together with the strengthening of the internal market. During the adoption of the secondary legal sources, the Commission encountered a problem of harmonization of legal sources. Due to the mismatch between the laws of Members States, the efforts are made to reach the full harmonization. In the area of the consumer protection, there were many directives adopted concerning this legal branch. Initiative of the rescue and protection of the abuse hastaken the consumers themselves by establishing consumer organizations, which are independent and non-governmental.
