Abstract

V preteklosti in danes je policija veljala in velja za avtoritativno vejo oblasti, ki jo širša javnost v veliki meri spoštuje. Policijska pooblastila predstavljajo velik poseg v človekovo svobodo. Prav zaradi takšne odgovornosti, ki jo imajo policisti, nemalokrat prihaja do različnih kršitev pravil, zakonov ali človekovih pravic ter svoboščin. Pri svojem opravljanju policijskih dolžnosti pogosto prekoračijo pooblastila in uporabo prisilnih sredstev izrabijo v svojo korist. Primeri, kot so ustrahovanje, izživljanje nad pridržano osebo zaradi njihovega nadrejenega položaja, prekomerna sila, neprimerna obravnava med policijskimi postopki, opustitev dejanja, so kazniva dejanja, ki zahtevajo nadaljnjo obravnavo na Ministrstvu za notranje zadeve. Nato se s pritožbami ukvarja Sektor za pritožbe zoper policijo, ki ugotavlja njihovo utemeljenost. Drugi dejavnik policijskega nasilja je rasna nestrpnost. Raziskave kažejo zelo jasno povezavo med policijskim nasiljem in rasizmom. Temnopolti so v Ameriki in drugod po svetu, kjer predstavljajo večji delež prebivalstva, največkrat žrtve policijske brutalnosti v obliki uporabe strelnega orožja. Poleg rasizma je velik razlog za pojav policijskega nasilja tudi stres, saj ta v veliki meri vpliva na sposobnost odločanja policista v krizni situaciji, ko ima policist le nekaj sekund za zakonito odločitev. Analiza nasilnega vedenja slovenskih policistov od leta 2013 do leta 2017 ne kaže rasti policijskega nasilja. Prav tako ne moremo trditi, da nasilje upada. Pritožbe, obravnavane zaradi kaznivih dejanj s strani policistov, nihajo iz leta v leto. Zato lahko še z večjo gotovostjo trdimo, da potrebujemo večje izboljšanje na področju preprečevanja policijskega nasilja. Nad policijo bo potrebno zagotoviti nadzor, ki bo učinkovit in bo prinašal vidne rezultate za uspešen razvoj Slovenske policije kot organizacije, ki stremi k napredku na področju zagotavljanja varovanja človekovih pravic in temeljnih svoboščin.

Secondary abstract: The police have always been the authoritative branch of government which has been respected by the broader public. Police powers represent a great interference in the freedom of an individual. Various violations of rules, laws or human rights and freedoms occur often because of the responsibilities the police officers have. In their performance of police duties, police officers often exceed their powers and abuse the use of restraints for their own benefits. Cases, such as intimidation, taking it out on persons in police custody because of police officers’ superior position, excessive use of force, inappropriate treatment during the police procedures, and omissions are criminal offenses which demand further examination at the Ministry of the Interior. Then, the Police Complaints Division examines the police complaints and the merits of the appeals. The other factor of police violence is racial bigotry. The research shows a very clear connection between police violence and racism. People of color in United States of America and in other parts of the world where they represent a larger portion of the population are victims of police brutality, on some occasions they are shot at. In addition to racism, stress is also a big reason for the emergence of police violence, as it influences the ability of a police officer in the crisis situation to a great extent when the police officer has only seconds to decide about a legitimate decision. The analysis of violent behavior of Slovenian police officers from 2013 to 2017 does not show any growth of police violence. We also cannot make an assertion that violence is declining. The numbers of complaints against the police fluctuate every year. Therefore, we can assert with even greater certainty that we need greater improvement in the field of preventing police violence. The control over the police will have to be ensured. It will have to be efficient and it will have to produce obvious results for the successful development of Slovenian Police as an organization which strives for the progress in the field of provision of the protection of the human rights and fundamental freedoms.
