Abstract

Avtorica analizira predlog ZVPot-1 na področju prenosa Direktive 1999/44/ES. Direktiva 1999/44/ES predstavlja temelje evropskega varstva potrošnikov, saj ureja osrednje institute obligacijskega prava - obvezno jamčevanje prodajalca za neskladnosti potrošniškega blaga s pogodbo in prostovoljno garancijo. Področje je trenutno urejeno z Zakonom o varstvu potrošnikov, ki pa je na večih mestih pomanjkljiv in neskladen z zahtevami Direktive. S ciljem zagotovitve ureditve, ki bo skladna z evropskim pravom avtorica kritično obravnava rešitve predloga in predlaga ustrezne spremembe. Temelj analize je primerjava skladnosti predloga ZVPot-1 z zahtevami Direktive 1999/44/ES in s sodbami Sodišča Evropske unije. Ob upoštevanju relevantne sodne prakse slovenskih sodišč, izhodišč pravne teorije in ciljev predloga ZVPot-1 ter Direktive avtorica ocenjuje primernost implementacije posameznih institutov. Pri analiziranju upošteva tudi potrebo po koherentnosti ureditve s splošnim slovenskim obligacijskih pravom in potrebo po jasnosti in smiselnosti zakonodajnih rešitev.

Secondary abstract: Author is analyzing legislative proposal ZVPot-1 regarding transposition of Directive 1999/44/ES. Directive deals with main institutes of the law of the contract - seller's mandatory liability for non-conformity of goods with the contract and voluntary guarantee. Therefore it represents foundation of European consumer protection. Consumer Protection Act, which is currently covering this field, is incomplete and inconsistent with requirements of the Directive 1999/44/ES. With the aim to ensure legal regime that will be consistent with requirements of the EU law, author critically discusses its legislative solutions and proposes appropriate amendments. The main part of analysis represents comparison of legislative proposal ZVPot-1 with requirements of Directive 1999/44/ES and relevant case law of the European Court of Justice. When assessing the suitability of implementation of Directive author takes into consideration relevant Slovenian case law, principles of legal literature and goals of Directive and legislative proposal. Author also takes notice of importance of consistency between the general Obligation Act and Consumer Protection Act and a need for clarity and feasibility of legislative regulation.
