Abstract

V slovenski praksi je sklepanje pogodb o zaposlitvi za določen čas globoko ukoreninjeno. Zakon o delovnih razmerjih (ZDR-1) poskuša omejiti uporabo pogodb za določen čas z naštevanjem taksativno določenih razlogov, v katerih je sklenitev pogodbe o zaposlitvi za določen čas dopustna. Delodajalci morajo pri sklepanju paziti tudi na časovno omejitev, ki jo zakon določa za te pogodbe. Zakonodajalec poskuša destimulirati delodajalce za sklepanje pogodb o zaposlitvi za določen čas z določitvijo odpravnine, ki pripada delavcu ob poteku pogodbe o zaposlitvi za določen čas. V primeru kršitve zakonskih določil pri sklepanju pogodbe o zaposlitvi za določen čas pride na podlagi zakona avtomatično do transformacije v pogodbo o zaposlitvi za nedoločen čas, ki je za delodajalca civilna sankcija. ZDR-1 je uvedel nekaj novosti, katerih namen in cilj sta bolj učinkovito omejevanje sklepanja pogodb o zaposlitvi za določen čas in preprečevanje zlorabe. Skozi pregled sodne prakse nepravilnosti pri sklepanju pogodb o zaposlitvi za določen čas in posledične transformacije v pogodbo za nedoločen čas se skuša ugotoviti, kako določbe zakona učinkujejo v praksi in kako sledijo namenu in ciljem najpomembnejših sprememb.

Secondary abstract: In the Slovenian practice, the conclusion of fixed-term employment contracts is firmly entrenched. Employment Relationships Act (ZDR-1) attempts to limit the use of fixed-term contracts by listing exhaustively determined reasons in which the conclusion of a fixed-term employment contract is permissible. When concluding, employers should also consider the time limit for these contracts. The legislature seeks to dissuade employers from concluding fixed-term employment contracts by determining the severance pay that belongs to the worker at the time of the termination of the fixed-term employment contract. In case of a breach of statutory provisions when concluding a fixed-term employment contract, on the basis of the law, it automatically becomes a transformation into an indefinite employment contract, which is a civil sanction for the employer. ZDR-1 introduced some amendments, the purpose and the goal, which are to limit the conclusion of fixed-term employment contracts more effectively and to prevent misuse. Through a review of the case law of irregularities in the conclusion of fixed-term employment contracts and subsequent transformations into an indefinite contract, we seek to determine how the provisions of the law are effective in practice and how they follow the purpose and goals of the most important changes.
