| Secondary abstract: | The thesis considers the (pre)contractual obligations of providing information to the lender in a credit agreement for consumers. It focuses on the amount of information to be given before the conclusion of a contract. Some issues are raised, such as loans in foreign currency and loans with a foreign currency clause that have appeared in the Slovenian case-law and the case-law of the Court of Justice of the European Union. The thesis considers the integration of clarity and comprehensibility of the main object of the contract with duly completed pre-contractual informed consent and hence possible assessment of the unfairness of such a contract term. Possible legal consequences of an unfair contract term as well as sanctions from the perspective of classical institutes of obligatory law are presented. |
