Abstract
Magistrsko delo se osredotoča na zakonsko ureditev brezplačne pravne pomoči v Republiki Sloveniji ter v tem kontekstu na področju brezplačne pravne pomoči predstavlja možnosti, ki so jih v praksi deležne socialno šibkejše osebe, ki po zakonu niso upravičene do brezplačne pravne pomoči. Nadalje predstavlja tudi vlogo nevladnih organizacij v slovenskem prostoru, katerih poslanstvo je doseganje splošno koristnih družbenih učinkov ob varovalkah, ki zagotavljajo kakovostno izvajanje njihovih dejavnosti, kar posledično pri samih dejavnostih pomeni pravno varnost ter učinkovite načine reševanja sporov skupaj z uporabniki.
Sam institut brezplačne pravne pomoči v prvi vrsti pomeni uresničevanje pravice do sodnega varstva. Po načelu enakopravnosti, ki izvira iz Deklaracije sedmih načel, sprejete 24. 10. 1970 v smislu priloge resolucije generalne skupščine Organizacije združenih narodov, mora država zagotoviti izvajanje te pravice vsem osebam, ki zaradi svojega premoženjskega stanja tega ne zmorejo same. Enakost pred zakonom, ki je splošno pravno načelo prava Unije in izvira iz skupne ustavne tradicije vseh držav članic, opredeljena pa je v 20. členu Listine Evropske unije o temeljnih pravicah, ter dostop do sodišča državljanom ne smeta biti zgolj formalno zagotovljeni, dejansko pa nedosegljivi pravici. Zato mora država hkrati omogočiti izvajanje teh pravic tudi na materialni ravni. In prav to pomeni pravico do brezplačne pravne pomoči.
Magistrsko delo poleg uvodnega zgodovinskega pregleda ureditve brezplačne pravne pomoči, ustavnih izhodišč ter samega zakona v osrednjem delu posveča pozornost analiziranju sodne statistike brezplačne pravne pomoči v Republiki Sloveniji. Ob tem ne gre spregledati dejstva, da bodo iz leta v leto stroški (poraba sredstev) samo še naraščali, saj se število procesnih dejanj z leti samo povečuje. Slednje je tudi povsem razumljivo in pričakovano. V delu je nadalje analiziran in na kratko prikazan pregled ureditve brezplačne pravne pomoči v tujini, natančneje v Nemčiji.
V sklepnem delu je v premislek dan okvir za ukrepe in predloge ki bi lahko prispevali k učinkovitejši ureditvi brezplačne pravne pomoči v Sloveniji. Predlagani ukrepi bi posredno prispevali k večjemu zaupanju javnosti in strank v institut brezplačne pravne pomoči in izboljšali njegovo ureditev.

Secondary abstract: |
This master's thesis focuses on the legal regulation of legal aid in the Republic of Slovenia. In this context, it introduces options that are in practice offered to the socially disadvantaged persons, who do not legally qualify for the legal aid. Furthermore, it presents the role of the non-governmental organizations in Slovenian space, which strive to achieve generally beneficial social effects through safeguards that ensure the quality of their activities, which consequently results in legal certainty and effective ways to resolve conflicts together with users.
The institution of legal aid by itself primarily means the realization of the right to justice. The Declaration on Principles of International Law Concerning Friendly Relations was accepted on October 24, 1970, in the sense of the annex to the resolution of the United Nations General Assembly. According to the principle of equality, which originates in this declaration, a country must ensure the exercise of this right to all people who can not do it by themselves due to their financial situation. Access to the court of law as well as equality before the law, which is a general legal principle of Union law, stems from the common constitutional tradition of all Member States and is defined in Article 20 of the Charter of Fundamental Rights of the European Union, must not only be formally guaranteed to the citizens but at the same time unavailable rights. Therefore, the state must at the same time allow the exercise of these rights at the material level. And this means exactly the right to free legal aid.
In addition to the introductory historical review of the free legal aid regulation, constitutional starting points, and the very law in the central part, the masters' thesis pays attention to the analysis of judicial statistics on free legal aid in the Republic of Slovenia. the fact that every year the costs (spending of funds) will only increase, as the number of procedural acts only increases over the years, should not be overlooked. The latter is completely understandable and expected. The thesis then analyzes and presents a brief overview of the regulation of free legal aid abroad, specifically in Germany.
In the concluding part, consideration is given to the framework for measures and proposals that could contribute to more effective regulation of free legal aid in Slovenia. The proposed measures would indirectly contribute to greater confidence of the public and clients in the institute of free legal aid and improve its regulation. |
