Abstract

Oblastvo nad nepremičninami je bogastvo, ki ga lahko lastnik z dobrim gospodarjenjem izkorišča. Nepremičnine so predmet trgovanja, varčevanja, špekuliranja in investiranja. Lastnik lahko prosto razpolaga s svojo lastnino, razen če zakon določa drugače. Prenos lastninske pravice je pri kmetijskih zemljiščih omejen, saj določa postopek in vrstni red predkupnih upravičencev. Zakonita predkupna pravica po ZKZ nima vpliva na lastnika nepremičnine ali bo nepremičnino prodal, ampak samo na to, komu jo bo prodal. Lastnik, ki želi prodati kmetijsko zemljišče, mora ponudbo izročiti pristojni upravni enoti, predkupni upravičenci pa morajo v roku 30 dni sprejeti ponudbo. Predkupni upravičenec, ki izpolnjuje pogoje po najboljšem vrstnem redu, ima prednost pred drugimi sprejemniki ponudbe. Po poteku roka za sprejem ponudbe, predkupni upravičenec poda vlogo za odobritev pravnega posla. Na podlagi pravnomočne odločbe o odobritvi pravnega posla, sklenjeni pogodbi in plačilu davka, kupec lahko poda predlog za vpis v zemljiško knjigo.

Secondary title: Legal pre-emptive right in agricultural land trading
Secondary abstract: Authority over the real estate is the wealth which could be exploited by the owner with good management. Real estate is the object of trade, saving money, speculation, and investment. An owner can freely have the power of disposal over its property, unless the law determines differently. The transfer of property right is limited in the case of agricultural areas, as it determines the procedure and the order of pre-emptive beneficiaries. The legal pre-emptive right according to the Agricultural Land Act has no influence on the owner of the real estate whether he will sell the real estate or not, but only to this to who he will sell it to. The owner who wishes to sell an agricultural area has to pass the offer to the administrative unit having jurisdiction and pre-emptive beneficiaries have to accept the offer within a time-limit of 30 days. A pre-emptive beneficiary who fulfills the conditions according to the best order has the advantage before other receivers of the offer. After the expiration of the period for acceptance of the offer, a pre-emptive beneficiary passes the application for the approval of the legal transaction. On the basis of the final decision on the approval of the legal transaction, the concluded agreement, and the payment of the tax, the purchaser can pass the proposal for land registration.
