Abstract

Z novim Zakonom o urejanju prostora, Gradbenim zakonom in Zakonom o arhitekturni in inženirski dejavnosti je domača prostorska zakonodaja doživela novo reformo. Zakonodaja, ki se je začela uporabljati pred slabim letom, naslavlja temeljne problematike na področju urejanja prostora in graditve objektov, razdrobljeno ureditev pa skuša poenotiti in narediti preglednejšo. Predmet magistrskega diplomskega dela je izpostavitev in analiza temeljnih novosti, ki jih prinašata Zakon o urejanju prostora in Gradbeni Zakon. Posamezne zakonske rešitve so podrobneje pravno razčlenjene, opisane v primerjavi s pravili, ki jih nadomeščajo in kritično obravnavane. Naloga je sestavljena iz dveh delov, ki ustrezata obravnavanima zakonoma. Znotraj posameznega dela so kot osrednji del naloge najprej izpostavljene sistemske oziroma ključne novosti, sledijo pa še ostale pomembne spremembe. Prvi del magistrske naloge je namenjen analizi novosti Zakona o urejanju prostora. V središču tega dela je obravnavana nova možnost sodnega varstva zoper prostorske izvedbene akte kot splošne pravne akte v upravnem sporu. Posebna pozornost je med drugim posvečena možnosti prevlade javne koristi, ki je v postopkih priprave prostorskih aktov določena na sistemski ravni, institutu lokacijske preveritve in preoblikovanemu postopku državnega prostorskega izvedbenega načrtovanja. Drugi del naloge je namenjen obravnavi rešitev, ki jih prinaša Gradbeni zakon. Posebna pozornost je namenjena najprej integraciji mnenj, ki nadomeščajo soglasja, v postopek izdaje gradbenega dovoljenja in nato združitvi samega postopka izdaje gradbenega dovoljenja s postopkom izdaje okoljevarstvenega soglasja za objekte z vplivi na okolje. Izpostavljena je tudi nova ureditev posebnih prepovedi za nedovoljen objekt in neskladno uporabo objekta, ki je povzročila veliko zmede pri poslovanju z nepremičninami.

Secondary abstract: With the new Spatial Planning Act, Building Act and Architecture and Civil Engineering Act, the national spatial legislation underwent another reform. The legislation, which has applied for under a year, addresses the fundamental issues in the areas of spatial management and construction, and tries to unify the partitioned regulation and to make it more orderly. This master`s thesis provides an overview and an analysis of principal innvoations of the new Spatial Planning Act and Building Act. Individual solutions are broken down in detail, and are contrasted with the previous regulation and examined critically. The thesis is comprised of two parts, one for each respective Act. An individual part summarises systemic or key solutions as its main section, followed by other important changes to the legislation. The first part of the thesis deals with the new Spatial Planning Act. As its perhaps most important subject, the part examines the administrative dispute as a new form of judicial protection against the spatial implementation plans as general legal acts. Inspected closely, among other things, are also the enactment of public interest predominance procedure at a systemic level into the procedures for drafting spatial planning documents, the mechanism of locational verification and the reformed procedure of state spatial implementation planning. The second part of the paper deals with key innovations of the Building Act. Examined first is the integration of opinions, substituting the approvals, into the procedure for issuing a building permit, and examined second is the integration of the above-mentioned procedure with the procedure for issuing an environmental approval for the buildings with environmental impacts. Also summarised is the new regulation of special prohibitions refering to unallowable construction and non-compliant use, which has caused a fair amount of confusion in legal transactions with real estate.
